           SEYFERT AND BENNINGHOFF, OCTOBER 28, 1997

                                     AN ACT

     1  Amending Title 66 (Public Utilities) of the Pennsylvania
     2     Consolidated Statutes, further providing for the prohibition
     3     against standby charges.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1326 of Title 66 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 1326.  Standby charge prohibited.
     9     (a)  Prohibition.--A public utility that furnishes water to
    10  or for the public shall not impose a standby charge on owners of
    11  residential, commercial or industrial structures equipped with
    12  automatic fire protection systems.
    13     (b)  Definition.--As used in this section, the term "standby
    14  charge" means an amount however styled, in addition to the
    15  regular rate, assessed against the owner of a residential,
    16  commercial or industrial structure for the reason that the
    17  residential, commercial or industrial structure is equipped with
    18  an automatic fire protection system.

     1     Section 2.  This act shall take effect in 60 days.
