                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for possession of
     3     firearms by minors and revoking the firearm license for
     4     certain offenders.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 6110.1 of Title 18 of the Pennsylvania
     8  Consolidated Statutes is amended to read:
     9  § 6110.1.  Possession of firearm by minor.
    10     (a)  Firearm.--Except as provided in subsection (b), a person
    11  under 18 years of age shall not possess or transport a firearm
    12  anywhere in this Commonwealth.
    13     (b)  Exception.--Subsection (a) shall not apply to a person
    14  under 18 years of age:
    15         (1)  who is under the supervision of a parent,
    16     grandparent, legal guardian or an adult acting with the
    17     expressed consent of the minor's custodial parent or legal
    18     guardian and the minor is engaged in lawful activity,


     1     including safety training, lawful target shooting, engaging
     2     in an organized competition involving the use of a firearm or
     3     the firearm is unloaded and the minor is transporting it for
     4     a lawful purpose; or
     5         (2)  who is lawfully hunting or trapping in accordance
     6     with 34 Pa.C.S. (relating to game).
     7     (c)  Responsibility of adult.--Any person who knowingly and
     8  intentionally delivers or provides to the minor a firearm in
     9  violation of subsection (a) commits a felony of the third
    10  degree.
    11     (d)  Forfeiture.--Any firearm in the possession of a person
    12  under 18 years of age in violation of this section shall be
    13  promptly seized by the arresting law enforcement officer and
    14  upon conviction or adjudication of delinquency shall be
    15  forfeited or, if stolen, returned to the lawful owner[.] unless
    16  such owner has delivered or provided a firearm to a minor or
    17  negligently permits a minor to possess a firearm, in such case
    18  the firearm shall be forfeited to the Commonwealth for
    19  destruction.
    20     (e)  Revocation of license.--Any adult who through his
    21  intentional or negligent conduct allows or permits a minor to
    22  possess or come into possession of a firearm shall have his
    23  firearm license revoked and shall not be eligible to obtain
    24  another license for a period of five years.
    25     Section 2.  This act shall take effect in 60 days.
