AN ACT
1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2 Consolidated Statutes, further providing for the offense of
3 recklessly endangering another person.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 2705 of Title 18 of the Pennsylvania
7 Consolidated Statutes is amended to read:
8 § 2705. [Recklessly endangering] Endangering another person.
9 [A person commits a misdemeanor of the second degree if he
10 recklessly engages in conduct which places or may place another
11 person in danger of death or serious bodily injury.]
12 (a) Offense defined.--A person commits the offense of
13 endangering another person if he:
14 (1) negligently discharges a firearm into the air under
15 circumstances manifesting indifference to the value of human
16 life; or
17 (2) recklessly engages in conduct which places or may
1 place another in danger of death or serious bodily injury.
2 (b) Grading.--An offense under subsection (a)(1) is a felony
3 of the third degree. An offense under subsection (a)(2) is a
4 misdemeanor of the second degree.
5 Section 2. This act shall take effect in 60 days.
