                                     AN ACT

     1  Providing for the capital budget for the fiscal year 1997-1998;
     2     itemizing public improvement projects and furniture and
     3     equipment projects to be constructed, acquired or assisted by
     4     the Department of General Services, together with their
     5     estimated financial costs; incurring of debt without the
     6     approval of the electors for the purpose of financing the
     7     projects to be constructed, acquired or assisted by the
     8     Department of General Services; stating the useful life of
     9     the projects; and making appropriations.

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12  Section 1.  Short title.
    13     This act shall be known and may be cited as the Capital
    14  Budget Act of 1997-1998.
    15  Section 2.  Total authorization.
    16     (a)  Public improvements.--The total authorization for the
    17  additional capital projects in the category of public
    18  improvement projects itemized in section 3 and to be constructed
    19  or acquired by the Department of General Services, its
    20  successors or assigns and to be financed by the incurring of
    21  debt shall be $295,000.

     1     (b)  Furniture and equipment.--The total authorization for
     2  the additional capital projects in the category of public
     3  improvement projects consisting of the acquisition of original
     4  movable furniture and equipment to complete public improvement
     5  projects itemized in section 4 and to be acquired by the
     6  Department of General Services, its successors or assigns and to
     7  be financed by the incurring of debt shall be $142,000.
     8  Section 3.  Itemization of public improvement projects.
     9     The additional capital projects in the category of public
    10  improvement projects to be constructed or acquired by the
    11  Department of General Services, its successors or assigns and to
    12  be financed by the incurring of debt are hereby itemized,
    13  together with estimated financial costs, as follows:

    29     Additional capital projects in the category of public
    30  improvement projects consisting of the acquisition of movable

     2  and to be purchased by the Department of General Services, its
     3  successors or assigns and to be financed by the incurring of
     4  debt are hereby itemized, together with their respective
     5  estimated financial costs, as follows:

    16  Section 5.  Debt authorization.
    17     (a)  Public improvements.--The Governor, Auditor General and
    18  State Treasurer are hereby authorized and directed to borrow,
    19  from time to time, in addition to any authorization heretofore
    20  or hereafter enacted, on the credit of the Commonwealth, subject
    21  to the limitations provided in the current capital budget, money
    22  not exceeding in the aggregate the sum of $295,000 as may be
    23  found necessary to carry out the acquisition and construction of
    24  the public improvement projects specifically itemized in a
    25  capital budget.
    26     (b)  Furniture and equipment.--The Governor, Auditor General
    27  and State Treasurer are hereby authorized and directed to borrow
    28  from time to time, in addition to any authorization heretofore
    29  or hereafter enacted, on the credit of the Commonwealth, subject
    30  to the limitations provided in the current capital budget, money

     1  not exceeding in the aggregate the sum of $142,000 as may be
     2  found necessary to carry out the public improvement projects
     3  consisting of the acquisition of original movable furniture and
     4  equipment specifically itemized in a capital budget.
     5  Section 6.  Issue of bonds.
     6     The indebtedness authorized in this act shall be incurred
     7  from time to time and shall be evidenced by one or more series
     8  of general obligation bonds of the Commonwealth in such
     9  aggregate principal amount for each series as the Governor, the
    10  Auditor General and the State Treasurer shall determine, but the
    11  latest stated maturity date shall not exceed the estimated
    12  useful life of the projects being financed as stated in section
    13  7.
    14  Section 7.  Estimated useful life and term of debt.
    15     (a)  Estimated useful life.--The General Assembly states that
    16  the estimated useful life of the public improvement projects
    17  itemized in this act is as follows:
    18         (1)  Public improvement projects, 30 years.
    19         (2)  Furniture and equipment projects, 10 years.
    20     (b)  Term of debt.--The maximum term of the debt authorized
    21  to be incurred under this act is 30 years.
    22  Section 8.  Appropriations.
    23     (a)  Public improvements.--The net proceeds of the sale of
    24  the obligations authorized in this act are hereby appropriated
    25  from the Capital Facilities Fund to the Department of General
    26  Services in the maximum amount of $295,000 to be used by it
    27  exclusively to defray the financial cost of the public
    28  improvement projects specifically itemized in a capital budget.
    29  After reserving or paying the expenses of the sale of the
    30  obligation, the State Treasurer shall pay to the Department of

     1  General Services the moneys as required and certified by it to
     2  be legally due and payable.
     3     (b)  Furniture and equipment.--The net proceeds of the sale
     4  of the obligations authorized in this act are hereby
     5  appropriated from the Capital Facilities Fund to the Department
     6  of General Services in the maximum amount of $142,000 to be used
     7  by it exclusively to defray the financial cost of the public
     8  improvement projects consisting of the acquisition of original
     9  movable furniture and equipment specifically itemized in a
    10  capital budget. After reserving or paying the expenses of the
    11  sale of the obligation, the State Treasurer shall pay to the
    12  Department of General Services the moneys as required and
    13  certified by it to be legally due and payable.
    14  Section 9.  Federal funds.
    15     In addition to those funds appropriated in section 8, all
    16  moneys received from the Federal Government for the projects
    17  specifically itemized in this act are also hereby appropriated
    18  for those projects.
    19  Section 10.  Editorial changes.
    20     In editing and preparing this act for printing following the
    21  final enactment, the Legislative Reference Bureau shall insert
    22  or revise letters or numbers for projects where the letters or
    23  numbers are missing or require revision. The Legislative
    24  Reference Bureau shall also revise the total monetary amounts
    25  for the total authorization, debt authorization, appropriations
    26  and departmental totals as necessary to agree with the total
    27  monetary amounts of the projects.
    28  Section 11.  Effective date.
    29     This act shall take effect immediately.
