                                     AN ACT

     1  Prohibiting the use by banks of fingerprint imaging for the
     2     negotiation of financial instruments.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Definitions.
     6     The following words and phrases when used in this act shall
     7  have the meanings given to them in this section unless the
     8  context clearly indicates otherwise:
     9     "Bank."  Any bank, savings and loan association, credit union
    10  or similar financial institutions operating under the laws of
    11  this Commonwealth and which offers checking accounts to the
    12  general public.
    13  Section 2.  Fingerprint imaging prohibited.
    14     It shall be unlawful for any bank to require the fingerprint
    15  imaging of a customer as a condition for the negotiation of a
    16  check or other financial instrument.
    17  Section 3.  Civil penalty.


     1     A bank which violates this act shall be liable for a civil
     2  penalty not to exceed $5,000. This penalty shall be assessed and
     3  collected by the Department of Banking.
     4  Section 4.  Effective date.
     5     This act shall take effect in 60 days.
