        SENATE AMENDMENTS TO HOUSE AMENDMENTS, OCTOBER 25, 1995

                                  A SUPPLEMENT

     1  To the act of July 6, 1995 (P.L.269, No.38), entitled "An act
     2     providing for the capital budget for the fiscal year 1995-
     3     1996," itemizing public improvement projects to be
     4     constructed or acquired by the Department of General
     5     Services, together with estimated financial costs;
     6     authorizing the incurring of debt without the approval of the
     7     electors for the purpose of financing the projects to be
     8     constructed or acquired by the Department of General
     9     Services; stating the estimated useful life of the projects;
    10     imposing certain preconditions on the Quehanna Boot Camp       <--
    11     Project; and making an appropriation.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14  Section 1.  Short title.
    15     This act shall be known and may be cited as the 1995 Special
    16  Session Somerset Hospital Conversion Security and Quehanna Boot
    17  Camp Project Itemization Act.
    18  Section 2.  Total authorization.
    19     The total authorization for the additional capital projects
    20  in the category of public improvement projects itemized in
    21  section 3 and to be constructed or acquired by the Department of


     1  General Services, its successors or assigns, and to be financed
     2  by the incurring of debt, shall be $12,520,000.
     3  Section 3.  Itemization of public improvement projects.
     4     The additional capital projects in the category of public
     5  improvement projects to be constructed or acquired by the
     6  Department of General Services, its successors or assigns, and
     7  to be financed by the incurring of debt, are hereby itemized,
     8  together with their estimated financial costs, as follows:

    25             dormitory capacity, office space,
    26             kitchen/dining area, supporting program
    27             space and recreation facilities            10,620,000
    28             (Base Project Allocation - $8,850,000)
    29             (Design and Contingencies - $1,770,000)
    30  Section 4.  Quehanna Boot Camp Project Limitation.                <--

     1     No moneys appropriated by this act or any other act to the
     2  Capital Facilities Fund may be expended for the Quehanna
     3  Motivational Boot Camp Project itemized in section 3(1)(ii)
     4  until such time as the General Assembly enacts legislation
     5  which:
     6         (1)  Increases the term of confinement of an eligible
     7     inmate to a minimum of three years and a maximum of six
     8     years; and
     9         (2)  Provides specific legislative authorization
    10     directing the Department of Corrections to enter into
    11     agreements with the various counties which permit, on a
    12     space-available basis, the transfer of county inmates who
    13     desire to participate in the motivational boot camp program.
    14  Section 5 4.  Debt authorization.                                 <--
    15     The Governor, the Auditor General and the State Treasurer are
    16  hereby authorized and directed to borrow, from time to time, in
    17  addition to any authorization heretofore or hereafter enacted,
    18  on the credit of the Commonwealth, subject to the limitations
    19  provided in the current capital budget, money not exceeding in
    20  the aggregate the sum of $12,520,000 as may be found necessary
    21  to carry out the construction or acquisition of the public
    22  improvement projects specifically itemized herein.
    23  Section 6 5.  Issue of bonds.                                     <--
    24     The indebtedness authorized in this act shall be incurred,
    25  from time to time, and shall be evidenced by one or more series
    26  of general obligation bonds of the Commonwealth in such
    27  aggregate principal amount for each series as the Governor,
    28  Auditor General and State Treasurer shall determine, but the
    29  latest stated maturity date shall not exceed the estimated
    30  useful life of the projects being financed as stated in section

     2  Section 7 6.  Estimated useful life and term of debt.             <--
     3     (a)  Estimated useful life.--The General Assembly states that
     4  the estimated useful life of the projects itemized in this act
     5  is 30 years.
     6     (b)  Term of debt.--The maximum term of the debt authorized
     7  to be incurred under this act is 30 years.
     8  Section 8 7.  Appropriation.                                      <--
     9     The net proceeds of the sale of the obligations authorized in
    10  this act are hereby appropriated from the Capital Facilities
    11  Fund to the Department of General Services in the maximum amount
    12  of $12,520,000 to be used by it exclusively to defray the
    13  financial cost of the public improvement projects specifically
    14  itemized herein. After reserving or paying the expenses of the
    15  sale of the obligation, the State Treasurer shall pay to the
    16  Department of General Services the moneys as required and
    17  certified by it to be legally due and payable.
    18  Section 9 8.  Federal funds.                                      <--
    19     In addition to those funds appropriated in section 8 7, all    <--
    20  moneys received from the Federal Government for the projects
    21  specifically itemized in this act are also appropriated for
    22  these projects.
    23  Section 10 9.  Editorial changes.                                 <--
    24     In editing and preparing this act for printing following the
    25  final enactment, the Legislative Reference Bureau shall insert
    26  or revise letters or numbers for projects where the letters or
    27  numbers are missing or require revision. The bureau shall also
    28  revise the total monetary amounts for the total authorization,
    29  debt authorization, appropriations and departmental totals as
    30  necessary to agree with the total monetary amounts of the

     2  Section 11 10.  Effective date.                                   <--
     3     This act shall take effect immediately.
