SENATE BILL

        AS AMENDED ON THIRD CONSIDERATION, JUNE 12, 1995

                                     AN ACT

     1  Amending the act of June 24, 1931 (P.L.1206, No.331), entitled
     2     "An act concerning townships of the first class; amending,
     3     revising, consolidating, and changing the law relating
     4     thereto," providing for compensation of township
     5     commissioner.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 703 of the act of June 24, 1931
     9  (P.L.1206, No.331), known as The First Class Township Code,
    10  reenacted and amended May 27, 1949 (P.L.1955, No.569) and
    11  amended December 20, 1991 (P.L.402, No.47), is amended to read:
    12     Section 703.  Compensation.--Each township commissioner may
    13  receive a salary, established by ordinance, of not more than
    14  [fifteen hundred] one thousand eight hundred seventy-five
    15  dollars per year in townships having a population of less than
    16  five thousand, not more than [two thousand] two thousand five
    17  hundred dollars per year in townships having a population of
    18  five thousand or more but less than ten thousand, not more than
    19  [twenty-six hundred] three thousand two hundred fifty dollars

     1  per year in townships having a population of ten thousand or
     2  more but less than fifteen thousand, not more than [thirty-three
     3  hundred] four thousand one hundred twenty-five dollars per year
     4  in townships having a population of fifteen thousand or more but
     5  less than twenty-five thousand, not more than [thirty-five
     6  hundred] four thousand three hundred seventy-five dollars per
     7  year in townships having a population of twenty-five thousand or
     8  more but less than thirty-five thousand, and not more than
     9  [four] five thousand dollars per year in townships having a
    10  population of thirty-five thousand or more. Such salaries shall
    11  be payable monthly or quarterly for the duties imposed by the
    12  provisions of this act. The population shall be determined by
    13  the latest available official census figures, except that no
    14  township shall be required to reduce the salary of a
    15  commissioner as a result of a decrease in population[.] OR WHEN   <--
    16  AN INCREASE IN SALARY IS AUTHORIZED PURSUANT TO THIS SECTION,
    17  THE INCREASE MAY BE APPLIED TO THE AMOUNT OF THE SALARY OF THE
    18  COMMISSIONER AT THE TIME SUCH AN INCREASE IS ENACTED BY THE
    19  BOARD OF COMMISSIONERS.
    20     Section 2.  This act shall take effect in 60 days.
