                                     AN ACT

     1  Amending the act of December 12, 1994 (P.L.944, No.134),
     2     entitled "An act providing for the establishment and
     3     implementation of farm safety and occupational health
     4     programs; creating and providing for the powers and duties of
     5     the Farm Safety and Occupational Health Advisory Board;
     6     conferring powers and duties on the Department of
     7     Agriculture, the Pennsylvania Emergency Management Agency and
     8     the State Workmen's Insurance Fund; providing for statistical
     9     assessment of farm accidents and occupational injuries and
    10     diseases, for the collection and compilation of data, for
    11     farm safety demonstrations, for farm safety committees and
    12     for funding; making appropriations; and making a repeal,"
    13     further providing for the Farm Safety and Occupational Health
    14     Advisory Board and for a continuing appropriation.

    15     The General Assembly of the Commonwealth of Pennsylvania
    16  hereby enacts as follows:
    17     Section 1.  Section 3(b) of the act of December 12, 1994
    18  (P.L.944, No.134), known as the Farm Safety and Occupational
    19  Health Act, is amended to read:
    20  Section 3.  Farm Safety and Occupational Health Advisory Board.

    22     (b)  Composition of advisory board.--The advisory board shall
    23  consist of [13] 17 members who by reason of training,

     1  occupation, experience or education are qualified to carry out
     2  the duties of the advisory board. The advisory board shall
     3  consist of the following members:
     4         (1)  The Secretary of Agriculture or his designee, who
     5     shall serve as chairman.
     6         (2)  The Secretary of Health or his designee.
     7         (3)  Three active farmers, each of whom shall represent a
     8     different Statewide general farm organization.
     9         (4)  An agricultural equipment and machinery manufacturer
    10     or dealer.
    11         (5)  An insurer of farmers for workers' compensation,
    12     health or liability purposes.
    13         (6)  A leader of an agriculture or rural youth
    14     organization.
    15         (7)  An agricultural chemical agent manufacturer or
    16     dealer.
    17         (8)  A vocational agricultural instructor.
    18         (9)  An emergency service provider.
    19         (10)  The director of PEMA or his designee.
    20         (11)  The dean of the College of Agricultural Sciences of
    21     The Pennsylvania State University or his designee.
    22         (12)  The chairperson and the minority chairperson of the
    23     Agriculture and Rural Affairs Committee of the Senate or
    24     their designee, and the chairperson and minority chairperson
    25     of the Agriculture and Rural Affairs Committee of the House
    26     of Representatives or their designee.

    28     Section 2.  Section 14 of the act is amended by adding a
    29  subsection to read:
    30     Section 14.  Appropriations.

     2     (c)  Additional appropriation.--All money which has been
     3  disencumbered from the purposes of the act of July 2, 1984
     4  (P.L.537, No.108), known as the Agricultural Development Act,
     5  subsequent to February 15, 1995, and prior to the effective date
     6  of this section, shall be allocated to the Department of
     7  Agriculture for farm safety and occupational health programs in
     8  accordance with this act.
     9     Section 3.  This act shall take effect immediately.
