                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," providing for the attendance of
     6     expelled students.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    10  as the Public School Code of 1949, is amended by adding a
    11  section to read:
    12     Section 1320.  Provisional Enrollment of Transferring
    13  Students.--The receiving school entity may enroll a pupil
    14  transferring from another district on a provisional basis until
    15  a certified copy of the pupil's disciplinary record or sworn
    16  statement as required in section 1304-A is received by the
    17  school entity. If the disciplinary record contains a history of
    18  misbehavior, the student may be placed in an alternative program

     1  and may be ineligible to participate in extracurricular
     2  activities at the discretion of the receiving entity. No school
     3  entity shall be required to admit a student who has been
     4  expelled from another school entity into its regular program
     5  until the period of expulsion has expired.
     6     Section 2.  This act shall take effect immediately.
