                                     AN ACT

     1  Authorizing certain persons to receive certification as a
     2     respiratory care practitioner by the State Board of Medicine
     3     or the State Board of Osteopathic Medicine under certain
     4     conditions.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7  Section 1.  Limited certification.
     8     Any person who has performed respiratory care services for at
     9  least five years immediately preceding January 1, 1994, shall
    10  receive a limited certification by the State Board of Medicine
    11  or the State Board of Osteopathic Medicine without the necessity
    12  of passage of an examination.
    13  Section 2.  Scope of authority.
    14     Any person who is certified in accordance with section 1
    15  shall only provide respiratory services under the supervision of
    16  an individual who obtained certification as a respiratory care
    17  practitioner under section 10.2(b)(1), (3) or (5) of the act of
    18  October 5, 1978 (P.L.1109, No.261), known as the Osteopathic


     1  Medical Practice Act, or section 36.1(b)(1), (3) or (5) of the
     2  act of December 20, 1985 (P.L.457, No.112), known as the Medical
     3  Practice Act of 1985.
     4  Section 3.  Repeals.
     5     The following acts and parts of acts are repealed insofar as
     6  they are inconsistent with this act:
     7     Sections 10.1 and 10.2 of the act of October 5, 1978
     8  (P.L.1109, No.261), known as the Osteopathic Medical Practice
     9  Act.
    10     Sections 13.1 and 36.1 of the act of December 20, 1985
    11  (P.L.457, No.112), known as the Medical Practice Act of 1985.
    12  Section 4.  Effective date.
    13     This act shall take effect immediately.
