                                     AN ACT

     1  Amending the act of July 2, 1984 (P.L.527, No.106), entitled "An
     2     act providing for the rehabilitation, development and
     3     acquisition of land, water and structural resources; defining
     4     the powers and duties of certain offices, agencies and
     5     municipalities; providing for the allotment of proceeds
     6     hereunder including Commonwealth grants; prescribing
     7     standards; and making appropriations," establishing priority
     8     funding for certain facilities damaged by the January 1996
     9     flood.

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12     Section 1.  Section 3 of the act of July 2, 1984 (P.L.527,
    13  No.106), known as the Recreational Improvement and
    14  Rehabilitation Act, amended June 30, 1990 (P.L.272, No.66), is
    15  amended to read:
    16  Section 3.  Eligible uses of funds.
    17     In order to foster economic development, funds shall be used
    18  only for the following purposes:
    19         (1)  (i)  Rehabilitation of parks, indoor recreation

     1         facilities, outdoor recreation facilities and public zoos
     2         where these facilities have deteriorated because they
     3         have met or exceeded their useful life or other reasons,
     4         where one responsible public agency has made reasonable
     5         efforts to address the deterioration or where such
     6         rehabilitation will significantly reduce the operation
     7         and maintenance costs for these facilities.
     8             (ii)  Facilities under subparagraph (i) that have
     9         been damaged as a result of the January 1996 flood shall
    10         receive priority for funding purposes until June 30,
    11         1998.
    12         (2)  Acquisition of land for public recreation or park
    13     areas, including acquisitions made to obtain critical
    14     inholding or buffer areas adjacent to existing park and
    15     recreation areas, or to preserve critical wildlife habitat
    16     areas, including wetlands, or to develop hunting, fishing,
    17     boating and snowmobiling areas and related support
    18     facilities.
    19         (3)  Acquisition, development and rehabilitation of
    20     historic or open space resources which are outstanding
    21     examples of Pennsylvania's cultural heritage and which will
    22     enhance community conservation and community economic
    23     development.
    24         (5)  Renovation of parks, indoor recreation facilities
    25     and outdoor recreation facilities to improve accessibility to
    26     special populations.
    27         (6)  Development of public park and recreation facilities
    28     on lands which have previously been acquired for these
    29     purposes or on lands acquired through this act.
    30         (7)  Preparation of comprehensive recreation plans, park

     1     master plans, feasibility studies, natural areas inventories,
     2     other park and recreation-related studies and implementation
     3     of special technical assistance initiatives as identified or
     4     deemed appropriate by the Department of Community Affairs.
     5     Section 2.  This act shall take effect immediately.
