                                     AN ACT

     1  Amending the act of June 3, 1937 (P.L.1333, No.320), entitled
     2     "An act concerning elections, including general, municipal,
     3     special and primary elections, the nomination of candidates,
     4     primary and election expenses and election contests; creating
     5     and defining membership of county boards of elections;
     6     imposing duties upon the Secretary of the Commonwealth,
     7     courts, county boards of elections, county commissioners;
     8     imposing penalties for violation of the act, and codifying,
     9     revising and consolidating the laws relating thereto; and
    10     repealing certain acts and parts of acts relating to
    11     elections," further providing for unlawful contributions.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14     Section 1.  Section 1634 heading of the act of June 3, 1937
    15  (P.L.1333, No.320), known as the Pennsylvania Election Code,
    16  amended November 26, 1978 (P.L.1313, No.318), is amended and the
    17  section is amended by adding a subsection to read:
    18     Section 1634.  Contributions by Agents; Anonymous
    19  Contributions; Cash Contributions; Funnelling Contributions.--

    21     (d)  (1)  It shall be unlawful for any person to make a
    22  contribution to a political committee or a political action

     1  committee pursuant to an express or implied agreement between
     2  the person and the political committee or political action
     3  committee that the contribution will be funnelled to or
     4  earmarked for a specific candidate.
     5     (2)  A person who violates clause (1) commits a misdemeanor
     6  and shall, upon conviction, be sentenced to pay a fine of not
     7  more than five thousand dollars ($5,000) or to imprisonment for
     8  not more than six (6) months, or both.
     9     (3)  For purposes of this subsection, "person" means an
    10  individual, firm, corporation, association, partnership,
    11  consortium, joint venture, commercial entity, authority,
    12  nonprofit corporation, labor organization, interstate body or
    13  other legal entity which is recognized by law as the subject of
    14  rights and duties.
    15     Section 2.  This act shall take effect in 60 days.
