                                     AN ACT

     1  Amending Title 34 (Game) of the Pennsylvania Consolidated
     2     Statutes, further providing for protective material required.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Section 2524 of Title 34 of the Pennsylvania
     6  Consolidated Statutes is amended to read:
     7  § 2524.  Protective material required.
     8     [(a)  General rule.--Unless further restricted by regulations
     9  of the commission, every person hunting for or assisting to hunt
    10  for deer, bear or woodchucks shall wear either a minimum of 250
    11  square inches of daylight fluorescent orange-colored material on
    12  the back and front combined or, in lieu thereof, a hat of the
    13  same color material. The material shall be worn so it is visible
    14  in a 360-degree arc. Unless otherwise specified by regulations
    15  of the commission, the provision of this section shall not apply
    16  to any season for using muzzle-loading firearms only or season
    17  for using bows and arrows only.]

     1     (a)  General rule.--Except as provided in subsection (a.1),
     2  every person hunting for or assisting to hunt for big game or
     3  small game shall wear a minimum of 250 square inches of daylight
     4  fluorescent orange-colored material on the head, chest and back
     5  combined. The material shall be worn so it is visible in a 360-
     6  degree arc.
     7     (a.1)  Exceptions.--The provisions of subsection (a) shall
     8  not apply to any season for:
     9         (1)  Using muzzle-loading firearms only.
    10         (2)  Hunting wild turkey, wherein every person hunting
    11     for or assisting to hunt for wild turkeys shall wear a
    12     minimum of 100 square inches of daylight fluorescent orange-
    13     colored material on the back and front combined or a hat of
    14     the same color material. This material shall be worn while
    15     moving to or from a calling or hunting position, but is not
    16     required to be worn while positioned and calling. The
    17     material shall be worn so it is visible in a 360-degree arc.
    18         (3)  Archery hunting only, except when archery season
    19     overlaps with small game season. During the overlap season,
    20     an archery hunter shall wear a minimum of 100 square inches
    21     of daylight fluorescent orange-colored material on the back
    22     and front combined or a hat of the same color material. This
    23     material shall be worn while the hunter is moving to and from
    24     a hunting position, but is not required to be worn while
    25     positioned. The material shall be worn so it is visible in a
    26     360-degree arc.
    27         (4)  Migratory waterfowl.
    28     (b)  Penalty.--A violation of this section is a summary
    29  offense of the fifth degree.
    30     Section 2.  Sections 141.41(2) (relating to general),

     1  141.43(3) (relating to deer) and 141.45(4) (relating to turkey)
     2  of 58 Pa. Code are hereby rescinded.
     3     Section 3.  This act shall take effect immediately.
