                                     AN ACT

     1  Authorizing and directing the Department of General Services,
     2     with the approval of the Governor, to convey to Penn Township
     3     a tract of land situate in Penn Township, Snyder County,
     4     Pennsylvania.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  The Department of General Services, with the
     8  approval of the Governor, is hereby authorized and directed on
     9  behalf of the Commonwealth of Pennsylvania to convey to Penn
    10  Township, Snyder County, the following tract of land situate in
    11  Penn Township, Snyder County, Pennsylvania, for a consideration
    12  of one-half of the fair market value, the following:
    13     All that certain tract or parcel of land situate in Penn
    14  Township, Snyder County, Pennsylvania, more particularly bounded
    15  and described as follows:
    16     Beginning at a point in the center line of Pennsylvania State
    17  Route 1011 which point is also the north corner of land of the
    18  Penn Township supervisors; thence along land of the Penn


     1  Township supervisors, south 38 degrees 51 minutes 52 seconds
     2  west a distance of 512.15 feet to a point; thence along same,
     3  south 5 degrees 15 minutes 49 seconds east a distance of 337.17
     4  feet to a point; thence along land now or formerly of Hank
     5  Chiarkas, south 84 degrees 44 minutes 11 seconds west a distance
     6  of 814.26 feet to a point; thence along land now or formerly of
     7  J. Walter Stauffer and Cleta H. Stauffer, north 4 degrees 51
     8  minutes 28 seconds west a distance of 1,684.55 feet to a point;
     9  thence along land of same and a dirt lane, north 84 degrees 44
    10  minutes 11 seconds east a distance of 323.20 feet to a point in
    11  the center line of Pennsylvania State Route 1011; thence along
    12  the center line of Pennsylvania State Route 1011, south 36
    13  degrees 54 minutes 25 seconds east a distance of 365.07 feet to
    14  a point; thence along same on a curve to the left having a
    15  radius of 1,031.09 feet and a length of 256.06 feet to a point;
    16  thence along same, south 51 degrees 8 minutes 8 seconds east a
    17  distance of 674.72 feet to a point, the place of beginning.
    18     Containing 30.28 acres of vacant land of which 0.49 of an
    19  acre is within the highway right-of-way. Being a portion of
    20  Parcel No. 107 on Snyder County Tax Map PN-8.
    21     Being part of Tract One which Stephen Traver, et al, by their
    22  deed dated February 19, 1919, recorded April 15, 1919, in the
    23  Office of the Recorder of Deeds in and for Snyder County at
    24  Middleburg, Pennsylvania, in Deed Book 40 at page 21, granted
    25  and conveyed to the Commonwealth of Pennsylvania.
    26     Section 2.  The conveyance shall be made under and subject to
    27  all easements, servitudes and rights of others, including, but
    28  not confined to, streets, roadways and rights of any telephone,
    29  telegraph, water, electric, sewer, gas or pipeline companies, as
    30  well as under and subject to any interest, estates or tenancies

     1  vested in third persons, whether or not appearing of record, for
     2  any portion of the land or improvements erected thereon.
     3     Section 3.  The deed of conveyance shall contain a clause
     4  that the property conveyed shall be used for any municipal
     5  purpose permitted under the act of May 1, 1933 (P.L.103, No.69),
     6  known as The Second Class Township Code, by Penn Township,
     7  Snyder County, and if at any time Penn Township or its successor
     8  in function conveys the property or permits the property to be
     9  used for any purpose other than those specified in this section,
    10  the title to the property shall immediately revert to and revest
    11  in the Commonwealth of Pennsylvania.
    12     Section 4.  The deed of conveyance shall be approved as
    13  provided by law and shall be executed by the Secretary of
    14  General Services in the name of the Commonwealth of
    15  Pennsylvania.
    16     Section 5.  Costs and fees incidental to this conveyance
    17  shall be borne by the grantee.
    18     Section 6.  This act shall take effect in 60 days.
