AN ACT 1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled 2 "An act providing for and reorganizing the conduct of the 3 executive and administrative work of the Commonwealth by the 4 Executive Department thereof and the administrative 5 departments, boards, commissions, and officers thereof, 6 including the boards of trustees of State Normal Schools, or 7 Teachers Colleges; abolishing, creating, reorganizing or 8 authorizing the reorganization of certain administrative 9 departments, boards, and commissions; defining the powers and 10 duties of the Governor and other executive and administrative 11 officers, and of the several administrative departments, 12 boards, commissions, and officers; fixing the salaries of the 13 Governor, Lieutenant Governor, and certain other executive 14 and administrative officers; providing for the appointment of 15 certain administrative officers, and of all deputies and 16 other assistants and employes in certain departments, boards, 17 and commissions; and prescribing the manner in which the 18 number and compensation of the deputies and all other 19 assistants and employes of certain departments, boards and 20 commissions shall be determined," further providing for 21 budget procedures. 22 The General Assembly of the Commonwealth of Pennsylvania 23 hereby enacts as follows: 24 Section 1. The act of April 9, 1929 (P.L.177, No.175), known 25 as The Administrative Code of 1929, is amended by adding a 26 section to read:
1 Section 625. Limit on Spending.--(a) The increase in the 2 total dollar amount of any fiscal year's general appropriation 3 made to a department over that made to that department for the 4 previous fiscal year shall not exceed the percentage increase of 5 the Consumer Price Index averaged over the preceding eight 6 fiscal years. 7 (b) The limit on the dollar increase described in subsection 8 (a) may be exceeded only by a two-thirds vote of both houses of 9 the General Assembly. 10 (c) Any department which currently exceeds the calculated 11 expenditure limit described in subsection (a) by more than ten 12 per centum (10%) of the total current excess deviation from the 13 formula described in subsection (a), when that formula is 14 applied to the current appropriation amount made to that 15 department, shall have three years to bring its expenditures 16 into compliance with this act. 17 (d) As used in this section, "department" shall mean any 18 agency, authority, board, bureau, commission, committee, court, 19 department, House of the General Assembly, office or any other 20 entity or activity which is given an appropriation from the 21 General Fund and which is listed as a separate section under 22 Part II of the act of May 28, 1993 (P.L.589, No.1A), known as 23 the "General Appropriation Act of 1993," and the equivalent 24 parts of succeeding general appropriation acts. 25 Section 2. This act shall apply to the 1995-1996 fiscal year 26 and to each fiscal year thereafter. 27 Section 3. This act shall take effect immediately. A12L71JRW/19950H0523B0551 - 2 -
