                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," providing for assistance to an
     6     exceptional child during transportation.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 1374 of the act of March 10, 1949
    10  (P.L.30, No.14), known as the Public School Code of 1949,
    11  amended June 7, 1993 (P.L.49, No.16), is amended to read:
    12     Section 1374.  Free Transportation or Board and Lodging.--Any
    13  exceptional child, who is regularly enrolled in a special class
    14  that is approved by the Department of Education, or who is
    15  enrolled in a regular class in which approved educational
    16  provisions are made for him, may be furnished with free
    17  transportation by the school district. An exceptional child who
    18  needs physical assistance during transportation shall be
    19  provided with an aide for the entire trip. When it is not


     1  feasible to provide such transportation the board of school
     2  directors may in lieu thereof pay for suitable board and lodging
     3  for any such child. If free transportation or board and lodging
     4  is not furnished for any exceptional child or any eligible young
     5  child as defined in the act of December 19, 1990 (P.L.1372,
     6  No.212), known as the "Early Intervention Services System Act,"
     7  who, by reason thereof, is unable to attend the class or center
     8  for which he is qualified, the intermediate unit shall provide
     9  the transportation necessary.
    10     Section 2.  This act shall take effect in 60 days.
