        REFERRED TO COMMITTEE ON JUDICIARY, JANUARY 31, 1995

                                     AN ACT

     1  Requiring counties committing offenders to the Department of
     2     Corrections to provide certain background information at the
     3     time of commitment.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6  Section 1.  Background information required.
     7     The Department of Corrections shall not accept within its
     8  custody, inmates who are transferred from county prisons where
     9  the county fails to provide, at the time of transfer, the
    10  following information:
    11         (1)  The presentence investigation, when available,
    12     including, but not limited to, information about the facts of
    13     the crime for which the inmate has been sentenced, including
    14     arrest reports, social history data, prior adult and juvenile
    15     criminal history and demographic information.
    16         (2)  When no presentence investigation is available,
    17     information about the facts of the crime for which the inmate


     1     has been sentenced, including arrest reports.
     2         (3)  For the crime the inmate is convicted of, the
     3     offense tracking number and the State identification number.
     4         (4)  A record of adjustment at the county level.
     5         (5)  Medical record, including certification that the
     6     inmate has been screened for infectious diseases, including,
     7     but not limited to, tuberculosis disease.
     8         (6)  Complete and accurate sentencing information,
     9     including a copy of the sentencing guideline form.
    10  Section 2.  Waiver.
    11     In the event of an emergency, the Secretary of Corrections,
    12  or his designee, may waive the requirements of this act.
    13  Section 3.  Effective date.
    14     This act shall take effect in 90 days.
