        SENATOR STEWART, COMMUNITY AND ECONOMIC DEVELOPMENT, AS AMENDED,
           MARCH 15, 1994

                                     AN ACT

     1  Providing grants for conducting assessments of abandoned
     2     industrial sites; establishing a fund; providing for           <--
     3     surcharges PROVIDING FOR FUNDING; and imposing duties upon     <--
     4     the Department of Commerce.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7  Section 1.  Short title.
     8     This act shall be known and may be cited as the Abandoned
     9  Industrial Sites Environmental Assessment Act.
    10  Section 2.  Grants for conducting environmental assessments of
    11                 abandoned industrial sites.
    12     The Department of Commerce shall make grants to
    13  municipalities, municipal or other local authorities, nonprofit
    14  economic development agencies and similar agencies to conduct
    15  environmental assessments of abandoned industrial sites located
    16  in municipalities which have been designated by the Department
    17  of Commerce as distressed communities under the act of July 2,


     1  1984 (P.L.520, No.105), known as the Business Infrastructure
     2  Development Act. Grants shall be made from the Abandoned
     3  Industrial Sites Environmental Assessment Fund.
     4  Section 3.  Abandoned Industrial Sites Environmental Assessment
     5                 Fund.
     6     There is hereby established within the State Treasury a
     7  special nonlapsing fund which shall be known as the Abandoned
     8  Industrial Sites Environmental Assessment Fund. The fund shall
     9  be administered by the Department of Commerce to carry out the
    10  purposes of this act.
    11  Section 4.  Surcharge.                                            <--
    12     There is hereby imposed a 10% surcharge on all fines and
    13  penalties imposed under the following acts:
    14         (1)  The act of July 7, 1980 (P.L.380, No.97), known as
    15     the Solid Waste Management Act.
    16         (2)  The act of July 28, 1988 (P.L.556, No.101), known as
    17     the Municipal Waste Planning, Recycling and Waste Reduction
    18     Act.
    19         (3)  The act of October 18, 1988 (P.L.756, No.108), known
    20     as the Hazardous Sites Cleanup Act.
    21  Proceeds from the surcharge shall be paid into the State
    22  Treasury for deposit into the Abandoned Industrial Sites
    23  Environmental Assessment Fund.
    24  SECTION 4.  CONTINUING APPROPRIATION.                             <--
    25     THE SUM OF $1,000,000 SHALL BE TRANSFERRED ANNUALLY BY THE
    26  STATE TREASURER FROM THE HAZARDOUS SITES CLEANUP FUND TO THE
    27  ABANDONED INDUSTRIAL SITES ENVIRONMENTAL ASSESSMENT FUND.
    28  Section 5.  Regulations.
    29     The Department of Commerce shall promulgate regulations to
    30  implement and administer the provisions of this act.

     1  Section 6.  Effective date.
     2     This act shall take effect in 60 days.
