                                     AN ACT

     1  Providing grants for conducting assessments of abandoned
     2     industrial sites; establishing a fund; providing for
     3     surcharges; and imposing duties upon the Department of
     4     Commerce.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7  Section 1.  Short title.
     8     This act shall be known and may be cited as the Abandoned
     9  Industrial Sites Environmental Assessment Act.
    10  Section 2.  Grants for conducting environmental assessments of
    11                 abandoned industrial sites.
    12     The Department of Commerce shall make grants to
    13  municipalities, municipal or other local authorities, nonprofit
    14  economic development agencies and similar agencies to conduct
    15  environmental assessments of abandoned industrial sites located
    16  in municipalities which have been designated by the Department
    17  of Commerce as distressed communities under the act of July 2,
    18  1984 (P.L.520, No.105), known as the Business Infrastructure

     1  Development Act. Grants shall be made from the Abandoned
     2  Industrial Sites Environmental Assessment Fund.
     3  Section 3.  Abandoned Industrial Sites Environmental Assessment
     4                 Fund.
     5     There is hereby established within the State Treasury a
     6  special nonlapsing fund which shall be known as the Abandoned
     7  Industrial Sites Environmental Assessment Fund. The fund shall
     8  be administered by the Department of Commerce to carry out the
     9  purposes of this act.
    10  Section 4.  Surcharge.
    11     There is hereby imposed a 10% surcharge on all fines and
    12  penalties imposed under the following acts:
    13         (1)  The act of July 7, 1980 (P.L.380, No.97), known as
    14     the Solid Waste Management Act.
    15         (2)  The act of July 28, 1988 (P.L.556, No.101), known as
    16     the Municipal Waste Planning, Recycling and Waste Reduction
    17     Act.
    18         (3)  The act of October 18, 1988 (P.L.756, No.108), known
    19     as the Hazardous Sites Cleanup Act.
    20  Proceeds from the surcharge shall be paid into the State
    21  Treasury for deposit into the Abandoned Industrial Sites
    22  Environmental Assessment Fund.
    23  Section 5.  Regulations.
    24     The Department of Commerce shall promulgate regulations to
    25  implement and administer the provisions of this act.
    26  Section 6.  Effective date.
    27     This act shall take effect in 60 days.
