                                     AN ACT

     1  Exempting certain residential child-care facilities from certain
     2     State regulations relating to revenue and compensation.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Certain residential child-care facilities exempt
     6                 from certain regulations.
     7     Any private nonprofit program which receives delinquents
     8  pursuant to 42 Pa.C.S. Ch. 63 (relating to juvenile matters) and
     9  is licensed by the Department of Public Welfare as a residential
    10  child-care facility, with a licensed capacity greater than 450
    11  delinquents at one location or site, which maintains a per diem
    12  cost of care as certified by the Auditor General of 80% or less
    13  than the cost of care billed to county institution districts for
    14  similar care provided at the lowest per diem cost of a similar
    15  State youth development center, and which does not in any one
    16  fiscal year seek an increase in its per diem cost which is

     1  greater than or equal to the Consumer Price Index for the
     2  preceding one-year fiscal period shall be exempt from any
     3  regulation promulgated subsequent to enactment of this section
     4  by the Department of Public Welfare or other executive agency
     5  regarding retained revenue, compensation of staff and revenue
     6  provisions for donations and gifts.
     7  Section 2.  Effective date.
     8     This act shall take effect immediately.
