AN ACT 1 Authorizing the Department of General Services, with the 2 approval of the Governor and the Department of Education, to 3 convey a tract of land located in the Borough of Edinboro, 4 Erie County, Pennsylvania, to the Borough of Edinboro. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. The Department of General Services, with the 8 approval of the Governor and the Department of Education, is 9 hereby authorized and directed to grant and convey to the 10 Borough of Edinboro, Erie County, Pennsylvania, the following 11 tract of land situate in the Borough of Edinboro. 12 All that certain piece or parcel of land bounded and 13 described as follows: 14 Beginning at a post in the north margin of South Street or 15 West Normal Street at the southeast corner of land of I. R. 16 Reeder; thence northwardly along the east line of said Reeder's 17 land to a post in the south line of land of J. R. Steadman; 18 thence eastwardly along the south line of J. R. Steadman 50 feet 19 to the west line of lot of Mrs. Estella Washburn; thence
1 southwardly along the said west line of Mrs. Estella Washburn's 2 land parallel with the west line above described to a post in 3 the north margin of South Street or West Normal Street thence 4 westwardly along the north margin of said street 50 feet to the 5 place of beginning, containing about 40 perches of land, being 6 west half of land conveyed to Henry Steadman, deceased, by Nancy 7 M. and I. N. Taylor. Being the land used and operated for the 8 purpose of a sewage disposal plant for the accommodation of the 9 said State Normal School. 10 Being the same land described in accordance with a deed 11 between the Trustees of the State Normal School of the Twelfth 12 District of Pennsylvania, a corporation of Edinboro, Erie 13 County, Pennsylvania, party of the first part, and the 14 Commonwealth of Pennsylvania, party of the second part, recorded 15 April 18, 1914, in Deed Book Volume 206 Page 437, in Erie 16 County, Pennsylvania. 17 Section 2. The conveyance shall be made under and subject to 18 all easements, servitudes and rights of others, including but 19 not confined to streets, roadways and rights of any telephone, 20 telegraph, water, electric, sewer, gas or pipeline companies, as 21 well as under and subject to any interest, estates or tenancies 22 vested in third persons, whether or not appearing of record, for 23 any portion of the land or improvements erected thereon. 24 Section 3. The deed of conveyance shall contain a clause 25 that the lands conveyed shall be used and developed as a public 26 park by the Borough of Edinboro and if at any time the borough 27 or its successor in function conveys said property or permits 28 said property to be used for any purpose other than those 29 aforementioned, the title thereto shall immediately revert to 30 and revest in the Commonwealth of Pennsylvania. 19940H2693B3500 - 2 -
1 Section 4. The deed of conveyance shall be approved as 2 provided by law and shall be executed by the Secretary of 3 General Services in the name of the Commonwealth of 4 Pennsylvania. 5 Section 5.
