AN ACT
1 Amending Title 42 (Judiciary and Judicial Procedure) of the
2 Pennsylvania Consolidated Statutes, providing for liability
3 of golf courses for injuries sustained on adjacent highways.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Title 42 of the Pennsylvania Consolidated
7 Statutes is amended by adding a section to read:
8 § 8311. Golf course liability for injuries sustained on
9 adjacent highways.
10 (a) General rule.--There shall be a right of action against
11 a proprietor of a golf course for injuries sustained by persons
12 on highways adjacent to golf courses, who are struck by a golf
13 ball hit from a golf course.
14 (b) Definitions.--As used in this section, the following
15 words and phrases shall have the meanings given to them in this
16 subsection:
17 "Golf course." Includes driving ranges.
18 "Persons." Includes pedestrians, motorists and passengers of
1 vehicles on adjacent highways.
2 Section 2. This act shall take effect in 60 days.
