                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for the offense of
     3     murder in the third degree and for attempted criminal
     4     homicide.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 2502 of Title 18 of the Pennsylvania
     8  Consolidated Statutes is amended by adding a subsection to read:
     9  § 2502.  Murder.

    11     (c.1)  Vehicle occupant's culpability.--
    12         (1)  A person commits murder in the third degree if he is
    13     an occupant of a vehicle from which or in which a weapon is
    14     intentionally discharged thereby killing a person.
    15         (2)  A person commits attempted criminal homicide if he
    16     is an occupant of a vehicle from which or in which a weapon
    17     is intentionally discharged with the purpose of injuring


     1     another person.

     3     Section 2.  This act shall take effect in 60 days.
