                                     AN ACT

     1  Requiring all principal owners of manufactured housing
     2     communities located in this Commonwealth to register annually
     3     with the Department of Community Affairs.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6  Section 1.  Short title.
     7     This act shall be known and may be cited as the Manufactured
     8  Housing Registration Act.
     9  Section 2.  Definitions.
    10     The following words and phrases when used in this act shall
    11  have the meanings given to them in this section unless the
    12  context clearly indicates otherwise:
    13     "Department."  The Department of Community Affairs of the
    14  Commonwealth.
    15     "Manufactured home."  A transportable single-family dwelling
    16  unit containing plumbing, heating and/or cooling and electrical
    17  systems intended for permanent occupancy constructed as a single
    18  unit or as two or more units designed to be joined into one

     1  integral unit which is built on a permanent chassis and designed
     2  to be used as a dwelling with or without a permanent foundation
     3  when connected to the required utilities.
     4     "Manufactured housing community."  Any site, lot, field or
     5  tract of land, privately or publicly owned or operated, upon
     6  which three or more manufactured homes, occupied for dwelling or
     7  sleeping purposes, are or are intended to be located, regardless
     8  of whether or not a charge is made for the accommodation.
     9     "Principal owner."  A person having majority or controlling
    10  interest in any site, lot, field or tract of land upon which a
    11  manufactured housing community is established or is intended to
    12  be located.
    13  Section 3.  Manufactured housing community registration form.
    14     A principal owner of a manufactured housing community in this
    15  Commonwealth shall be required to fill out a manufactured
    16  housing community registration form prepared by the department.
    17  Section 4.  Contents of form.
    18     The manufactured housing community registration form shall
    19  include, but not be limited to, the following information:
    20         (1)  The name of the manufactured housing community and
    21     the county and municipality in which it is located.
    22         (2)  The name, address and telephone number of the
    23     principal owner of the manufactured housing community.
    24         (3)  The names and addresses of anyone having a financial
    25     interest in the manufactured housing community.
    26         (4)  The number of acres in the manufactured housing
    27     community.
    28         (5)  The number of developed homesites in the
    29     manufactured housing community, including the number
    30     currently occupied and currently vacant.

     1         (6)  The monthly rent charged.
     2         (7)  A list of any additional charges and fees and the
     3     amount of same.
     4  Section 5.  Filing.
     5     The registration form shall be filed with the department
     6  annually and shall include a filing fee of $3 for each developed
     7  homesite located in the manufactured housing community.
     8  Section 6.  Transfer of funds.
     9     All funds received by the department from manufactured
    10  housing communities filing the annual registration form and the
    11  annual filing fee per homesite shall be submitted by the
    12  department to the State Treasurer to be placed in the restricted
    13  account established for the operation of the Office of the
    14  Manufactured Housing Ombudsman and the Manufactured Housing
    15  Hearing Board.
    16  Section 7.  Regulations.
    17     The department shall promulgate rules and regulations to
    18  carry out the provisions of this act.
    19  Section 8.  Enforcement.
    20     (a)  Civil penalty.--A civil penalty of $500 shall be
    21  assessed on a principal owner for failure to comply with the
    22  provisions of this act.
    23     (b)  Rental charges.--No manufactured home community shall be
    24  entitled to levy rental charges for any space located in the
    25  community unless they have complied with the provisions of this
    26  act.
    27     (c)  Attorney General.--The Attorney General shall enforce
    28  the provisions of this section.
    29  Section 9.  Effective date.
    30     This act shall take effect in 30 days.
