AN ACT 1 Amending Title 34 (Game) of the Pennsylvania Consolidated 2 Statutes, authorizing out-of-State issuing agents in certain 3 states. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 2722 of Title 34 of the Pennsylvania 7 Consolidated Statutes is amended to read: 8 § 2722. Authorized license-issuing agents. 9 (a) County treasurer and commission employees.--Each county 10 treasurer or, in home rule or optional plan counties, the person 11 whose duties encompass those of a county treasurer, whose agency 12 has not been recalled under this title, shall accept 13 applications and issue licenses in accordance with this title. 14 The director may also designate commission employees at 15 commission facilities to issue licenses. 16 (b) Agents for issuing antlerless deer licenses.--Antlerless
1 deer licenses shall be issued by the county treasurer or, in 2 home rule or optional plan counties, the person whose duties 3 encompass those of a county treasurer within the county in which 4 the licenses are valid. 5 (c) Agent for issuing bear and nonresident furtaker 6 licenses.--Bear and nonresident furtaker licenses shall be 7 issued only by the commission or by authorized license-issuing 8 agents designated by the director. 9 (c.1) Out-of-State issuing agents.--No issuing agent in New 10 Jersey, Delaware, Maryland, West Virginia, Ohio or New York is 11 permitted to issue a license unless that state permits 12 Pennsylvania agents to issue its licenses. 13 (d) Appointment of additional agents.--The commission may 14 appoint such number of qualified persons, with similar 15 authority, as it deems necessary for the efficient distribution 16 of licenses required by this title. 17 (e) Agent responsible for employees.--The authorized agent 18 shall be solely responsible for each person acting under his 19 direction. 20 (f) Recall of appointment or authority.--The director may 21 recall the appointment or authority of any county treasurer or 22 other agent at any time. 23 (g) Regulations.--The commission shall adopt regulations 24 for: 25 (1) The appointment of hunting or furtaker license- 26 issuing agents and shall establish the appropriate 27 administrative fee for creating and maintaining these issuing 28 agents. County treasurers shall be exempt from the payment of 29 any administrative fee established by the commission. 30 (2) The administration, control and performance of 19930H1305B1444 - 2 -
