                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, providing for the issuance of handicapped personal
     3     plates.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Sections 1338(a) and 1341 of Title 75 of the
     7  Pennsylvania Consolidated Statutes are amended to read:
     8  § 1338.  Handicapped plate and placard.
     9     (a)  Handicapped plate.--On the application of any person
    10  who:
    11         (1)  is blind;
    12         (2)  does not have full use of an arm or both arms;
    13         (3)  cannot walk 200 feet without stopping to rest;
    14         (4)  cannot walk without the use of, or assistance from,
    15     a brace, cane, crutch, another person, prosthetic device,
    16     wheelchair or other assistive device;
    17         (5)  is restricted by lung disease to such an extent that


     1     the person's forced (respiratory) expiratory volume for one
     2     second, when measured by spirometry, is less than one liter
     3     or the arterial oxygen tension is less than 60 mm/hg on room
     4     air at rest;
     5         (6)  uses portable oxygen;
     6         (7)  has a cardiac condition to the extent that the
     7     person's functional limitations are classified in severity as
     8     Class III or Class IV according to the standards set by the
     9     American Heart Association;
    10         (8)  is severely limited in his or her ability to walk
    11     due to an arthritic, neurological or orthopedic condition; or
    12         (9)  is a person in loco parentis of a person specified
    13     in paragraph (1), (2), (3), (4), (5), (6), (7) or (8);
    14  the department shall issue a special registration plate which at
    15  the request of the applicant and the payment of the appropriate
    16  fee may be a personal plate, for one passenger car or other
    17  vehicle with a registered gross weight of not more than 9,000
    18  pounds, designating the vehicle so licensed as being used by a
    19  handicapped person. Special plates for handicapped persons may
    20  also be issued for vehicles operated exclusively for the use and
    21  benefit of handicapped persons.

    23  § 1341.  Personal plate.
    24     Upon request by the applicant, the department may issue
    25  registration plates, including handicapped registration plates,
    26  consisting of any combination of numbers, letters or numbers and
    27  letters. These special plates may be issued for special groups
    28  or for special purposes and bear an appropriate designation.
    29  They shall have the same force and effect as regular
    30  registration plates. The department may refuse any combination

     1  of letters and numbers for cause and shall adopt reasonable
     2  rules and regulations for the issuance of the plates and for
     3  carrying out the provisions of this section. The applicant shall
     4  comply with all laws and regulations pertaining to registration
     5  including the payment of any additional fees.
     6     Section 2.  This act shall take effect in 60 days.
