                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for purchase,
     3     consumption, possession or transportation of alcohol by
     4     certain persons and for possession of false identification to
     5     obtain alcohol.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Sections 6308(b) and 6310.3(b) of Title 18 of the
     9  Pennsylvania Consolidated Statutes are amended to read:
    10  § 6308.  Purchase, consumption, possession or transportation of
    11             liquor or malt or brewed beverages.

    13     (b)  [Penalty] Minimum penalty.--In addition to the penalty
    14  imposed pursuant to section 6310.4 (relating to restriction of
    15  operating privileges), a person convicted of violating
    16  subsection (a) [may] shall be sentenced to pay a fine of not
    17  more than $500 [for the second and each subsequent violation].
    18  There shall be no authority in any court to impose on an
    19  offender any lesser sentence than the minimum sentence mandated


     1  by this subsection. No court shall have the authority to suspend
     2  any sentence as defined in this section.

     4  § 6310.3.  Carrying a false identification card.

     6     (b)  Minimum penalty.--In addition to any other penalty
     7  imposed pursuant to section 6310.4 (relating to restriction of
     8  operating privileges) or any other statute, a person who is
     9  convicted of violating subsection (a) shall be sentenced to pay
    10  a fine of not more than $500 [for the second and subsequent
    11  violations]. No court shall have the authority to suspend any
    12  sentence as defined in this section.

    14     Section 2.  The amendment of 18 Pa.C.S. §§ 6308(b) and
    15  6310.3(b) shall apply to sentences imposed on or after the
    16  effective date of this act.
    17     Section 3.  This act shall take effect in 60 days.
