AN ACT 1 Authorizing the Pennsylvania Historical and Museum Commission to 2 establish a volunteer program. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 Section 1. Pennsylvania Historical and Museum Commission 6 volunteers. 7 The Pennsylvania Historical and Museum Commission is 8 authorized to recruit, train and accept, without regard to the 9 civil service classification laws, rules or regulations, the 10 services of individuals without compensation as volunteers for 11 or in aid of interpretive functions, visitor services, 12 conservation measures and development or other activities in and 13 related to all Commonwealth programs administered by the 14 commission. 15 Section 2. Expenses. 16 The Pennsylvania Historical and Museum Commission is
1 authorized to provide for incidental expenses, such as 2 transportation, uniforms, lodging and subsistence, incurred by 3 volunteers in the course of their service as volunteers. 4 Section 3. Employment status. 5 (a) Volunteer employees.--Except as otherwise provided in 6 this section, a volunteer shall not be deemed to be a 7 Commonwealth employee and shall not be subject to the provisions 8 of law relating to Commonwealth employment, including those 9 relating to hours of work, rates of compensation, leave, 10 unemployment compensation and Commonwealth employee benefits. 11 (b) Vehicle use.--Volunteers performing work under the terms 12 of this act shall be authorized to operate Commonwealth vehicles 13 and shall be treated for the purposes of automotive and general 14 liability as employees of the Commonwealth. 15 (c) Work injuries.--For the purposes of the act of June 2, 16 1915 (P.L.736, No.338), known as The Pennsylvania Workmen's 17 Compensation Act, relating to compensation to employees for work 18 injuries, volunteers under the provisions of this act shall be 19 deemed employees of the Commonwealth within the meaning of the 20 term "employe" as defined in section 104 of that act, and the 21 provisions of that act shall apply. 22 (d) Current assignments.--No volunteer shall be assigned to 23 any position presently filled in the Pennsylvania Historical and 24 Museum Commission. 25 Section 4. Powers and regulatory authority. 26 The Pennsylvania Historical and Museum Commission shall have 27 the power and the authority to do all things necessary and 28 expedient to establish and operate a volunteer program and to 29 promulgate rules and regulations under this act. 30 Section 5.
