AN ACT 1 Authorizing the Department of General Services, with the 2 approval of the Governor, to sell and convey to Dayton Parts, 3 Inc., a tract of land located on Verbeke Street in the City 4 of Harrisburg, Dauphin County, Pennsylvania; and authorizing 5 the Department of General Services, with the approval of the 6 Governor, to convey to the City of Harrisburg a certain tract 7 of land situate in the City of Harrisburg, Dauphin County, 8 Pennsylvania. 9 The General Assembly of the Commonwealth of Pennsylvania 10 hereby enacts as follows: 11 Section 1. (a) The Department of General Services, with the 12 approval of the Governor, is hereby authorized and directed on 13 behalf of the Commonwealth of Pennsylvania to grant and convey 14 to Dayton Parts, Inc., for the consideration of $11,900 the 15 following tract of land and buildings erected thereon: 16 All that certain lot, piece or parcel of land situate, lying 17 and being in the City of Harrisburg, Dauphin County, 18 Pennsylvania, bounded and described as follows: 19 Beginning at a point, said point being located north 52 20 degrees 29 minutes 35 seconds east, a distance of 80.85 feet to 21 an iron pin on the east side of North 10th Street; thence from
1 said point of beginning by other lands of Commonwealth of 2 Pennsylvania north 03 degrees 28 minutes 01 second west, a 3 distance of 245.11 feet to a point; thence by same north 03 4 degrees 10 seconds west, a distance of 122.52 feet to a point; 5 thence by same north 18 minutes 57 seconds east, a distance of 6 201.55 feet to a point; thence by land now or formerly of Dayton 7 Parts, Inc. south 02 degrees east, a distance of 323.86 feet to 8 a spike; thence by same north 88 degrees 04 minutes east, a 9 distance of 38.27 feet to a point; thence by same south 24 10 degrees 21 minutes east, a distance of 44.10 feet to a concrete 11 monument; thence by same and crossing Verbeke Street (vacated) 12 south 03 degrees 14 minutes east, a distance of 78.41 feet to a 13 point; thence continuing across Verbeke Street (vacated) and now 14 or formerly Dayton Parts, Inc. south 17 degrees 06 minutes 03 15 seconds west, a distance of 120.25 feet to a drill hole; thence 16 by same south 52 degrees 29 minutes 35 seconds west, a distance 17 of 21.01 feet to the place of beginning. 18 Being Lot No. 2, Subdivision Plan - Commonwealth of 19 Pennsylvania. (Drawing No. D2-1262, 18 inches x 24 inches, 2 20 sheets). 21 Containing 12,990.35 square feet. 22 (b) This conveyance shall be made under and subject to all 23 easements, servitudes and rights of others, including but not 24 confined to streets, roadways, and rights of any telephone, 25 telegraph, water, electric, sewer, gas or pipeline companies, as 26 well as under and subject to any interest, estates or tenancies 27 vested in third persons, whether or not appearing of record, for 28 any portion of the land or improvements erected thereon. 29 (c) The Deed of Conveyance shall be approved as provided by 30 law and shall be executed by the Secretary of General Services 19920H2720B3589 - 2 -
1 in the name of the Commonwealth of Pennsylvania. 2 (d) Costs and fees incidental to this conveyance shall be 3 borne by the grantee. 4 Section 2. (a) The Department of General Services, with the 5 approval of the Governor, is hereby authorized and directed, on 6 behalf of the Commonwealth of Pennsylvania, to grant and convey 7 to the City of Harrisburg, for one-half of the fair market value 8 as determined by an independent appraiser approved by the 9 Department of General Services, the following tract of land 10 situate in the City of Harrisburg, Dauphin County, Pennsylvania, 11 bounded and described as follows: 12 Beginning at the southwestern corner of State Street and 13 North Thirteenth Street; thence southwardly along the western 14 side of North Thirteenth Street 102 feet, more or less, to the 15 center of a 4 feet wide private alley and land now or late of 16 Harry Zuckerman; thence westwardly along the line of said 17 property and at right angles to North Thirteenth Street and for 18 part of the distance through the center of said alley 89 feet, 19 more or less, to the property now or formerly of Rose Handler; 20 thence northwardly along the line of said property and parallel 21 with North Thirteenth Street 53 feet, more or less, to a point; 22 thence westwardly along the line of said property and at right 23 angles to North Thirteenth Street 61 feet, more or less, to the 24 eastern side of Linden Street; thence northwardly along hte 25 eastern side of Linden Street, 29 feet, more or less, to the 26 southern side of State Street and thence eastwardly along the 27 southern side of State Street 151.08 feet, more or less, to the 28 point and place of beginning. 29 Together with the right to the use of the private alley 30 aforesaid as provided in and by the deed from Charles A. 1 et ux to John W. Cowden, dated November 15, 1900, and recorded 2 in the Office of the Recorder of Deeds in and for Dauphin County 3 in Deed Book "Q", Vol. 10, page 396. Subject to the restrictions 4 in Deed Book "Z", Vol. 10, page 373. 5 Together with all and singular the lands, buildings, ways, 6 waters, watercourses, rights, liberties, privileges, 7 hereditaments, and appurtenances whatsoever thereunto belonging 8 or in anywise appertaining and the reversions and remainders, 9 rents, issues, and profits thereof and all the estate, right, 10 title interest, use, trust, property, possession, claim and 11 demand whatsoever, inlaw, equity, or otherwise howsoever, of, 12 in, to, or out of the same. 13 Being the same property which Norman M. Lloyd, widow et al., 14 by deed dated May 27, 1944, and recorded in the Office of the 15 Recorder of Deeds of Dauphin County in Deed Book "U" Vol. 26, 16 page 306. Granted and conveyed unto the Commonwealth of 17 Pennsylvania, its successors and assigns. 18 (b) The conveyance shall be made under and subject to all 19 easements, servitudes and rights of others, including, but not 20 confined to, streets, roadways and rights of telephone, 21 telegraph, water, electric, sewer, gas or pipeline companies, as 22 well as under and subject to any interest, estates or tenancies 23 vested in third persons, whether or not appearing of record, for 24 any portion of the land or improvements erected thereon. 25 (c) The deed of conveyance shall be approved as provided by 26 law and shall be executed by the Secretary of General Services 27 in the name of the Commonwealth of Pennsylvania and shall be 28 developed in accordance with "The Secretary of the Interior's 29 Standards for Rehabilitation and Guidelines for Rehabilitation 30 of Historic Buildings (United States Department of the Interior, 19920H2720B3589 - 4 -
1 National Park Service, 1983.)" Development plans for the 2 property must be submitted to the Bureau of Historic 3 Preservation, Pennsylvania Historical and Museum Commission, 4 P.O. Box 1026, Harrisburg, PA 17108-1026. 5 (d) Costs and fees incidental to this conveyance shall be 6 borne by the grantee. 7 Section 3. This act shall take effect immediately.
