                                     AN ACT

     1  Amending the act of July 28, 1953 (P.L.723, No.230), entitled,
     2     as amended, "An act relating to counties of the second class
     3     and second class A; amending, revising, consolidating and
     4     changing the laws relating thereto," providing for
     5     appointments by the board of county commissioners in a county
     6     of the second class A in certain cases.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 503 of the act of July 28, 1953 (P.L.723,
    10  No.230), known as the Second Class County Code, is amended to
    11  read:
    12     Section 503.  Quorum; Execution of Official Instruments.--(a)
    13  The commissioners shall constitute a board, two members of which
    14  shall be a quorum for the transaction of business, and when
    15  convened in pursuance of notice or according to adjournment
    16  shall be competent to perform all the duties appertaining to the
    17  office of county commissioners.
    18     (b)  Where any official document, instrument or official
    19  paper is to be executed by the county commissioners, it shall be


     1  done by at least two of the commissioners and attested by the
     2  chief clerk who shall affix the county seal thereto.
     3     (c)  Notwithstanding subsection (a) or (b) or any other
     4  provision of law to the contrary, in a county of the second
     5  class A where two commissioners have either been defeated in an
     6  attempt to be reelected to the board or have chosen not to seek
     7  reelection, the board of county commissioners shall have no
     8  power to appoint persons to an authority, board, commission or
     9  similar body from the date of the municipal election to the last
    10  day of the commissioner's term of office.
    11     Section 2.  This act shall take effect in 60 days.
