                                     AN ACT

     1  Amending Title 23 (Domestic Relations) of the Pennsylvania
     2     Consolidated Statutes, further providing for medical history
     3     information.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 2909 of Title 23 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 2909.  Medical history information.
     9     (a)  Delivery of information.--[Medical history information
    10  shall, where practicable,] Family medical history information
    11  shall be delivered by the [attending physician] natural parents
    12  or other designated person to the intermediary who shall deliver
    13  such information to the adopting parents [or their physician].
    14  In cases where there is no intermediary, medical history
    15  information shall be delivered directly to the adopting parents
    16  [or their physician].
    17     (b)  Updates.--If critical family medical history information

     1  comes to light after the adoption, it shall be delivered by the
     2  natural parents or other designated person to the intermediary
     3  who shall deliver it to the adoption parents. If there was no
     4  intermediary, the information shall be delivered directly to the
     5  adoption parents, unless the address is unknown in which case it
     6  shall be delivered to the prothonotary of the court in the
     7  county where the adoption occurred. In the latter circumstance,
     8  the prothonotary shall supervise delivery of the information to
     9  the adoption parents.
    10     [(b)] (c)  Editing of information.--In all cases, medical
    11  history information shall be edited before delivery so as to
    12  remove any contents which would identify the adoptee's natural
    13  family.
    14     [(c)] (d)  Regulations.--The Pennsylvania Department of
    15  Health shall implement the provisions of this section by
    16  regulation.
    17     Section 2.  This act shall take effect in 60 days.
