AN ACT
1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2 Consolidated Statutes, prohibiting the improper use of
3 municipal recycling containers.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Title 18 of the Pennsylvania Consolidated
7 Statutes is amended by adding a section to read:
8 § 6713. Improper use of municipal recycling containers.
9 (a) Offense defined.--A person commits a summary offense if
10 he uses a recycling container for any purpose other than that
11 for which it was supplied if the container is owned by a
12 municipality or a party under contract with a municipality and
13 is clearly marked as to ownership and supplied to him for the
14 deposit of materials to be collected.
15 (b) Improper deposit or sorting of materials.--The improper
16 deposit or sorting of materials for collection shall not
17 constitute an offense under this section.
18 (c) Penalty.--A person committing an offense under this
1 section shall be sentenced to pay a fine of not more than $300.
2 Section 2. This act shall take effect in 60 days.
