                                     AN ACT

     1  Amending the act of December 15, 1982 (P.L.1266, No.287),
     2     entitled "An act conferring limited residency status on
     3     military personnel and their dependents assigned to an active
     4     duty station in Pennsylvania," further providing for rates of
     5     tuition for certain military personnel and their dependents.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 1 of the act of December 15, 1982
     9  (P.L.1266, No.287), entitled "An act conferring limited
    10  residency status on military personnel and their dependents
    11  assigned to an active duty station in Pennsylvania," is amended
    12  to read:
    13     Section 1.  [From and after the effective date of this act,
    14  the] (a)  General rule.--The term "resident" or "[residency"]
    15  residency," or any other term or expression used to designate a
    16  Commonwealth resident student, when used to determine the rate
    17  of tuition to be charged students attending community colleges,


     1  State-related and State-owned institutions of higher learning
     2  shall be construed to mean and include any military personnel or
     3  their dependents who are assigned to an active duty station in
     4  Pennsylvania and who reside in Pennsylvania.
     5     (b)  Definitions.--As used in this section, the following
     6  words and phrases shall have the meanings given them in this
     7  subsection:
     8     "Community colleges."  Institutions now or hereafter created
     9  pursuant to Article XIX-A of the act of March 10, 1949 (P.L.30,
    10  No.14), known as the Public School Code of 1949, or the act of
    11  August 24, 1963 (P.L.1132, No.484), known as the Community
    12  College Act of 1963.
    13     "State-owned institutions."  Those institutions which are
    14  part of the State System of Higher Education pursuant to Article
    15  XX-A of the act of March 10, 1949 (P.L.30, No.14), known as the
    16  Public School Code of 1949.
    17     "State-related institutions."  The Pennsylvania State
    18  University, the University of Pittsburgh, Temple University and
    19  Lincoln University and their branch campuses.
    20     Section 2.  This act shall take effect in 60 days.
