        the House of Representatives and Senate for the purpose of
        considering House Bill No. 1536, entitled:
        "An act to provide from the General Fund for the expenses of the
        Executive, Legislative and Judicial Departments of the
        Commonwealth, the public debt and for the public schools for the
        fiscal year July 1, 1991, to June 30, 1992, and for the payment
        of bills incurred and remaining unpaid at the close of the
        fiscal year ending June 30, 1991; to provide appropriations from
        the State Lottery Fund, the Pennsylvania Economic Revitalization

                                     AN ACT

     1  To provide from the General Fund for the expenses of the
     2     Executive, Legislative and Judicial Departments of the
     3     Commonwealth, the public debt and for the public schools for
     4     the fiscal year July 1, 1991, to June 30, 1992, for certain
     5     institutions and organizations, and for the payment of bills
     6     incurred and remaining unpaid at the close of the fiscal year
     7     ending June 30, 1991; to provide appropriations from the
     8     State Lottery Fund, the Pennsylvania Economic Revitalization
     9     Fund, the Energy Conservation and Assistance Fund, the
    10     Hazardous Material Response Fund, The State Stores Fund and
    11     the Emergency Medical Services Operating Fund to the
    12     Executive Department; to provide appropriations from the
    13     Judicial Computer System Augmentation Account to the Judicial
    14     Department; to provide appropriations from the Motor License
    15     Fund for the fiscal year July 1, 1991, to June 30, 1992, for
    16     the proper operation of the several departments of the
    17     Commonwealth and the Pennsylvania State Police authorized to
    18     spend Motor License Fund moneys; to provide for the
    19     appropriation of Federal funds to the Executive and Judicial
    20     Departments of the Commonwealth and for the establishment of
    21     restricted receipts accounts for the fiscal year July 1,
    22     1991, to June 30, 1992, for the payment of bills incurred and
    23     remaining unpaid at the close of the fiscal year ending June
    24     30, 1991, and for the transfer of certain funds; and making a

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9                               PART I
    10                         GENERAL PROVISIONS
    11     Section 101.  Short title.--This act shall be known and may
    12  be cited as the General Appropriation Act of 1991.
    13     Section 102.  Definitions.--The following words and phrases
    14  when used in this act shall have the meanings given to them in
    15  this section unless the context clearly indicates otherwise:
    16     "Employees."  Includes all directors, superintendents, bureau
    17  or division chiefs, assistant directors, assistant
    18  superintendents, assistant chiefs, experts, scientists,
    19  engineers, surveyors, draftsmen, accountants, secretaries,
    20  auditors, inspectors, examiners, analysts, statisticians,
    21  marshals, clerks, stenographers, bookkeepers, messengers and
    22  other assistants in any department, board or commission.
    23     "Expenses" and "maintenance."  Includes all printing, binding
    24  and stationery, food and forage, materials and supplies,
    25  traveling expenses, training, motor vehicle supplies and
    26  repairs, freight, express and cartage, postage, telephones and
    27  telegraph rentals and toll charges, newspaper advertising and
    28  notices, public advertising by or through any medium, fuel,
    29  light, heat, power and water, minor construction and renovation,
    30  repairs or reconstruction of equipment, buildings and

     1  facilities, rent of real estate and equipment, premiums on
     2  workmen's compensation, insurance premiums on policies of
     3  liability insurance, insurance premiums on medical payment
     4  insurance and surety bonds for volunteer workers, premiums on
     5  employee group life insurance and employee and retired employee
     6  group hospital and medical insurance, payment of Commonwealth
     7  share of Social Security taxes and unemployment compensation
     8  costs for State employees, the purchase of replacement or
     9  additional equipment and machinery and all other incidental
    10  costs and expenses, including payment to the Department of
    11  General Services of mileage and other charges for the use of
    12  automobiles and rental payments for permanently assigned
    13  automobiles and of expenses or costs of services incurred
    14  through the Purchasing Fund. The term "expenses" also shall
    15  include the medical costs for the treatment of inmates of State
    16  institutions when the inmate must be transferred to an outside
    17  hospital: Provided, That in no case shall the State institution
    18  pay more for patient care than that provided under the State
    19  medical assistance program.
    20     Section 103.  Abbreviations.--The following abbreviations
    21  when used in this act shall have the meanings given to them in
    22  this section unless the context clearly indicates otherwise:
    23     "ADA."  Anti-Drug Abuse.
    24     "ADMSBG."  Alcohol and Drug Abuse and Mental Health Services
    25  Block Grant.
    26     "AFDC."  Aid to Families with Dependent Children.

    13  compensation and travel expenses of the duly elected or
    14  appointed officers and employees of the Commonwealth, for the
    15  payment of fees for contractual services rendered, for the
    16  purchase or rental of goods and services, printing, public
    17  advertising by or through any medium, equipment, land and
    18  buildings and for payment of any other expenses, as provided by
    19  law or by this act, necessary for the proper conduct of the
    20  duties, functions and activities and for the purposes
    21  hereinafter set forth for the fiscal year beginning July 1,
    22  1991, and for the payment of bills incurred and remaining unpaid
    23  at the close of the fiscal year ending June 30, 1991.
    24     (b)  State Lottery Fund.--The following sums set forth in
    25  this act, or as much thereof as may be necessary, are hereby
    26  specifically appropriated from the State Lottery Fund to the
    27  several hereinafter named agencies of the Executive Department
    28  of the Commonwealth for the payment of fees for contractual
    29  services rendered, for the purchase or rental of goods and
    30  services and for payment of any other expenses, as provided by

     1  law or by this act, necessary for the proper conduct of the
     2  duties, functions and activities and for the purposes
     3  hereinafter set forth for the fiscal year beginning July 1,
     4  1991, and for the payment of bills incurred and remaining unpaid
     5  at the close of the fiscal year ending June 30, 1991.
     6     (c)  Pennsylvania Economic Revitalization Fund.--The
     7  following sums set forth in this act, or as much thereof as may
     8  be necessary, are hereby specifically appropriated from the
     9  Pennsylvania Economic Revitalization Fund to the several
    10  hereinafter named agencies of the Executive Department of the
    11  Commonwealth for the payment of fees for contractual services
    12  rendered, for the purchase or rental of goods and services and
    13  for the payment of any other expenses, as provided by law or by
    14  this act, necessary for the proper conduct of the duties,
    15  functions and activities and for the purposes hereinafter set
    16  forth for the fiscal year beginning July 1, 1991, and for the
    17  payment of bills incurred and remaining unpaid at the close of
    18  the fiscal year ending June 30, 1991.
    19     (d)  Energy Conservation and Assistance Fund.--The following
    20  sums set forth in this act, or as much thereof as may be
    21  necessary, are hereby specifically appropriated from the Energy
    22  Conservation and Assistance Fund to the several hereinafter
    23  named agencies of the Executive Department of the Commonwealth
    24  for the payment of fees for contractual services rendered, for
    25  the purchase or rental of goods and services and for the payment
    26  of any other expenses, as provided by law or by this act,
    27  necessary for the proper conduct of the duties, functions and
    28  activities and for the purposes hereinafter set forth for the
    29  fiscal year beginning July 1, 1991, and for the payment of bills
    30  incurred and remaining unpaid at the close of the fiscal year

     1  ending June 30, 1991.
     2     (e)  Judicial Computer System Augmentation Account.--The
     3  following sums set forth in this act, or as much thereof as may
     4  be necessary, are hereby specifically appropriated from the
     5  restricted receipt account established within the General Fund,
     6  known as the Judicial Computer System Augmentation Account, to
     7  the Judicial Department of the Commonwealth for the payment of
     8  fees for contractual services rendered, for the purchase or
     9  rental of goods and services and for the payment of any other
    10  expenses, as provided by law or by this act, necessary for the
    11  proper conduct of the duties, functions and activities and for
    12  the purposes hereinafter set forth for the fiscal year beginning
    13  July 1, 1991, and for the payment of bills incurred and
    14  remaining unpaid at the close of the fiscal year ending June 30,
    15  1991.
    16     (f)  Emergency Medical Services Operating Fund.--The
    17  following sums set forth in this act, or as much thereof as may
    18  be necessary, are hereby specifically appropriated from the
    19  Emergency Medical Services Operating Fund to the several
    20  hereinafter named agencies of the Executive Department of the
    21  Commonwealth for the payment of fees for contractual services
    22  rendered, for the purchase or rental of goods and services and
    23  for the payment of any other expenses, as provided by law or by
    24  this act, necessary for the proper conduct of the duties,
    25  functions and activities and for the purposes hereinafter set
    26  forth for the fiscal year beginning July 1, 1991, and for the
    27  payment of bills incurred and remaining unpaid at the close of
    28  the fiscal year ending June 30, 1991.
    29     (g)  The State Stores Fund.--The following sums set forth in
    30  this act, or as much thereof as may be necessary, are hereby

     1  specifically appropriated from The State Stores Fund to the
     2  hereinafter named agency of the Executive Department of the
     3  Commonwealth for the payment of fees for contractual services
     4  rendered, for the purchase or rental of goods and services and
     5  for the payment of any other expenses, as provided by law or by
     6  this act, necessary for the proper conduct of the duties,
     7  functions and activities and for the purposes hereinafter set
     8  forth for the fiscal year beginning July 1, 1991, and for the
     9  payment of bills incurred and remaining unpaid at the close of
    10  the fiscal year ending June 30, 1991.
    11     (h)  Motor License Fund.--The following sums, or as much
    12  thereof as may be necessary, are hereby appropriated from the
    13  Motor License Fund to the hereinafter named agencies of the
    14  Commonwealth for the payment of salaries, wages and other
    15  compensation and travel expenses of the duly elected or
    16  appointed officers and employees of the Commonwealth, for
    17  contractual services and other expenses necessary for the proper
    18  conduct of the duties, functions and activities for the purposes
    19  hereinafter set forth for the fiscal year beginning July 1,
    20  1991, and for the payment of bills incurred and remaining unpaid
    21  at the close of the fiscal year ending June 30, 1991.
    22     (i)  Aviation Restricted Revenue Account.--The following
    23  sums, or as much thereof as may be necessary, are hereby
    24  appropriated from the Aviation Restricted Revenue Account in the
    25  Motor License Fund to the hereinafter named agencies of the
    26  Commonwealth for the purposes set forth herein for the fiscal
    27  year beginning July 1, 1991, and for the payment of bills
    28  incurred and remaining unpaid at the close of the fiscal year
    29  ending June 30, 1991.
    30     (j)  Hazardous Material Response Fund.--The following sums

     1  set forth in this act, or as much thereof as may be necessary,
     2  are hereby specifically appropriated from the Hazardous Material
     3  Response Fund to the several hereinafter named agencies of the
     4  Executive Department of the Commonwealth for the payment of fees
     5  for contractual services rendered, for the purchase or rental of
     6  goods and services and for the payment of any other expenses, as
     7  provided by law or by this act, necessary for the proper conduct
     8  of the duties, functions and activities and for the purposes
     9  hereinafter set forth for the fiscal year beginning July 1,
    10  1991, and for the payment of bills incurred and remaining unpaid
    11  at the close of the fiscal year ending June 30, 1991.
    12     Section 105.  Federal augmentation appropriations.--The
    13  following Federal augmentation appropriations set forth in this
    14  act, or as much thereof as may be necessary, are hereby
    15  specifically appropriated from the Federal augmentation funds to
    16  the several hereinafter named agencies of the Executive and
    17  Judicial Departments of the Commonwealth for the payment of the
    18  expenses of implementing and carrying out the programs stated
    19  herein for the fiscal year beginning July 1, 1991, and for the
    20  payment of bills incurred and remaining unpaid at the close of
    21  the fiscal year ending June 30, 1991. Unless otherwise stated,
    22  the appropriations include any carryovers from the prior fiscal
    23  year.
    24     Section 106.  Job Training Partnership Act appropriations.--
    25  The following sums set forth in this act, or as much thereof as
    26  may be necessary, are hereby appropriated from the Job Training
    27  Partnership Act (JTPA) funds to the several hereinafter named
    28  agencies of the Executive Department of the Commonwealth for the
    29  payment of the expenses of implementing and carrying out the
    30  program stated herein for the fiscal year beginning July 1,

     2     Section 107.  Block grants.--(a)  Appropriation.--The
     3  following sums set forth in this act, or as much thereof as may
     4  be necessary, are hereby specifically appropriated from the
     5  block grant (BG) funds to the several hereinafter named agencies
     6  of the Executive Department of the Commonwealth for the
     7  purposes, and under the restrictions, for which the funds are
     8  provided for the fiscal year beginning July 1, 1991.
     9     (b)  Small Communities Development Block Grant.--The Small
    10  Communities Development Block Grant (SCDBG) is to assist small
    11  cities and communities that have a high concentration of
    12  impoverished citizens and substandard housing to expand their
    13  low and moderate income housing opportunities and to meet
    14  community development needs.
    15     (c)  Community Services Block Grant.--The Community Services
    16  Block Grant (CSBG) is to provide a range of services and
    17  activities having a measurable and potentially major impact on
    18  the causes of poverty in the community or those areas of the
    19  community where poverty is a particularly acute problem. In
    20  addition, new focus may be placed on the unemployed, both old
    21  and new. Local agencies may lower their eligibility requirements
    22  for recipients to three months to allow greater flexibility to
    23  assure proper consideration of each recipient.

    28  reimbursement for common pleas court
    29  judge authorized positions, no county
    30  shall receive less than 75% of the

     5     For the purpose of determining the
     6  actual direct costs incurred by the

     9  pleas, the costs as reported to the
    10  Department of Community Affairs in the
    11  county's annual audit and financial
    12  report forms under the heading "(a)
    13  Judicial," but confined to the
    14  subheading "(4184) courts, excluding
    15  capital outlay," shall be used. If a
    16  city coterminous with a county does
    17  not report on the Department of
    18  Community Affairs' form, its figures
    19  from the same subheading, set forth in

    21     All payments for reimbursement

     3                SPECIAL PROVISIONS FOR FEDERAL FUNDS
     4     Section 1201.  General Fund repository for Federal funds.--
     5  All moneys received from the Federal Government as contributions
     6  or supplements to the departments or agencies of the
     7  Commonwealth or the programs herein provided shall be paid into
     8  the General Fund.
     9     Section 1202.  Limitation on encumbering or spending Federal
    10  funds.--Federal funds shall be encumbered or spent only to the
    11  extent that such funds are estimated as being available during
    12  the fiscal year of the Commonwealth.
    13     Section 1203.  Appropriation of prior unspent Federal
    14  funds.--Any Federal money which has been previously appropriated
    15  by the General Assembly and authorized or allocated by the
    16  Federal Government but remains unspent from prior fiscal years,
    17  and will not be renewed for fiscal year 1991-1992, is hereby
    18  appropriated.
    19     Section 1204.  Subgrants between Federal fund
    20  appropriations.--With the exception of Federal money received
    21  under JTPA and SSBG, subgrants may be made between
    22  appropriations without further approval of the General Assembly.
    23  The Secretary of the Budget shall submit a list of subgrants to
    24  the Chairmen of the House and Senate Appropriations Committees
    25  quarterly. No subgrant to a State agency, however, may be made
    26  from a restricted receipt account without a specific
    27  appropriation by the General Assembly.
    28     Section 1205.  Utilization of emergency Federal funds.--(a)
    29  Federal funds available for costs and damages resulting from
    30  natural disasters or civil disobedience may be added to an

     1  appropriation contained in this act or to funds appropriated or
     2  may be used for the purposes prescribed by the Federal
     3  Government.
     4     (b)  In addition to the moneys appropriated by this act, all
     5  moneys received from the Federal Government for the purpose of
     6  disaster assistance or relief shall be paid into the General
     7  Fund and are hereby appropriated out of the General Fund to the
     8  departments, boards, commissions or agencies designated by the
     9  Governor.
    10     (c)  In the event of any emergency situation in which the
    11  General Assembly cannot act in sufficient time, the Governor is
    12  authorized through executive authorization to provide up to
    13  $5,000,000 in Federal funds to alleviate the emergency
    14  situation.  For the purposes of this section, "emergency" is
    15  defined as any situation in which there is a chance of, or which
    16  may result in, substantial human suffering.
    17                             PART XIII
    18                      MISCELLANEOUS PROVISIONS
    19     Section 1301.  Prior laws unaffected.--This act is not
    20  intended to be inconsistent with or to repeal any provision of
    21  any act enacted at this or any prior session of the General
    22  Assembly regulating the purchase of supplies, the ordering of
    23  printing and binding, the purchase, maintenance and use of
    24  automobiles, the method of making payments from the State
    25  Treasury for any purpose or the functioning of any
    26  administrative department, board or commission.
    27     Section 1302.  Compliance with other law before funds
    28  available.--No appropriation made by this act to any department,
    29  board, commission or agency of the Executive Department shall be
    30  available unless and until the department, board, commission or

     1  agency has complied with sections 615 and 616 of the act of
     2  April 9, 1929 (P.L.177, No.175), known as The Administrative
     3  Code of 1929.
     4     Section 1303.  Contracts prerequisite to encumbering or
     5  committing funds.--Funds for the purchase of supplies, materials
     6  and equipment shall not be deemed to be committed or encumbered
     7  until contracts covering the purchase have been entered into
     8  with the vendors.
     9     Section 1304.  Minority business set-asides.--(a)  Each
    10  department or other instrumentality of the Commonwealth listed
    11  in Subpart A of Part II, authorized to contract for buildings,
    12  highways, commodities, equipment, supplies or services, shall
    13  report to the General Assembly all information pertinent to
    14  anticipated procurement needs at the beginning of each fiscal
    15  year and each fiscal quarter thereafter.
    16     (b)  As used in this section, the term "minority business"
    17  means a minority business enterprise as defined in the act of
    18  July 22, 1974 (P.L.598, No.206), known as the Pennsylvania
    19  Minority Business Development Authority Act.
    20     Section 1305.  Appropriation of funds from miscellaneous
    21  sources.--(a)  In addition to the amounts appropriated by this
    22  act, moneys received in payment for food and household supplies
    23  furnished to employees and other persons, except inmates, by an
    24  institution, and moneys received from the proceeds from the sale
    25  of any products of the soil, meats, livestock, timber or other
    26  materials sold by the department shall be paid into the General
    27  Fund and are hereby appropriated out of the General Fund to the
    28  several respective institutions for the operation and
    29  maintenance of the institutions.
    30     (b)  In addition to the amounts appropriated by this act, all

     1  moneys received from any other source, except the Federal
     2  Government, as contributions for the programs provided herein or
     3  as payment for services or materials furnished by one
     4  institution to another, except those collections designated as
     5  revenues, shall be paid into the General Fund and are hereby
     6  appropriated out of the General Fund for the purposes of the
     7  respective appropriations.
     8     (c)  In addition to any funds specifically appropriated by
     9  this act, all moneys received by a department or agency of the
    10  Commonwealth from any other sources, except the Federal
    11  Government, as contributions or supplements to the department or
    12  agency for a program or administration of an act included in
    13  this act shall be paid into the General Fund and credited to the
    14  appropriation for that program or administration of the act.
    15     Section 1306.  Transfer from mortgage assistance program.--
    16  The sum of $12,000,000 is transferred from the Homeowner's
    17  Emergency Mortgage Assistance Program into the General Fund.
    18     Section 1307.  Lapsing of unused funds.--(a)  Except as
    19  otherwise provided by law or in this section, that part of all
    20  appropriations in Parts II, III, IV, V, VI, VII, VIII, IX, X and
    21  XI unexpended, uncommitted or unencumbered as of June 30, 1992,
    22  shall automatically lapse as of that date.
    23     (b)  The appropriations in Part II to the Department of
    24  Commerce for industrial resource centers and biotechnology
    25  research shall be two-year continuing appropriations.
    26     (c)  The appropriations in Part II to the Department of
    27  Community Affairs for housing and redevelopment assistance,
    28  enterprise development and low-interest local government loans
    29  shall be two-year continuing appropriations.
    30     (d)  The appropriation in Part II to the Department of

     1  Education for JTPA matching funds shall be a two-year continuing
     2  appropriation.
     3     (e)  The appropriations in Part II to the Department of
     4  Environmental Resources for the Chesapeake Bay Pollution
     5  Abatement Program, and the black fly control program shall be
     6  continuing appropriations.
     7     (f)  The appropriation in Part II to the Pennsylvania Higher
     8  Education Assistance Agency for urban and rural loan forgiveness
     9  shall be a two-year continuing appropriation.
    10     (g)  The appropriations in Part II to the Legislative
    11  Department shall be continuing appropriations.
    12     (h)  The appropriation in Part IV to the Department of
    13  Community Affairs for the Recreation Improvement and
    14  Rehabilitation Act shall be a three-year continuing
    15  appropriation.
    16     (i)  The appropriation in Part IV to the Department of
    17  Community Affairs for housing and redevelopment economic set-
    18  aside shall be a two-year continuing appropriation.
    19     (j)  The appropriation in Part IV to the Department of Labor
    20  and Industry for the Pennsylvania Conservation Corps shall be a
    21  two-year continuing appropriation.
    22     (k)  The appropriation in Part IV to the Department of
    23  Commerce for business infrastructure development shall be a two-
    24  year continuing appropriation.
    25     (l)  The appropriation in Part V to the Pennsylvania Energy
    26  Office shall be a two-year continuing appropriation.
    27     (m)  The appropriations in section 921 of Part IX for airport
    28  development, runway rehabilitation, business airport grants and
    29  real estate tax rebate payments shall be two-year continuing
    30  appropriations.

     1     (n)  Notwithstanding the provisions of subsection (f) of
     2  section 606 of the act of July 1, 1981 (P.L.628, No.5A), known
     3  as the General Appropriation Act of 1981, the appropriation in
     4  Part IV of that act to the Legislative Reapportionment
     5  Commission shall be a continuing appropriation.
     6     (o)  Notwithstanding the provisions of section 1406(f) of the
     7  act of July 1, 1989 (P.L.801, No.3A), known as the General
     8  Appropriation Act of 1989, all of the appropriation in Part III
     9  of that act to the Department of Health for residential drug
    10  treatment programs and all except $375,000 to the Pennsylvania
    11  State Police for drug law enforcement activities shall be three-
    12  year continuing appropriations.
    13     Section 1308.  Repeal.--Section 1206(q) of the act of July 1,
    14  1990 (P.L.    , No.7A), known as the General Appropriation Act
    15  of 1990, is repealed.
    16                              PART XIV
    17                           EFFECTIVE DATE
    18     Section 1401.  Effective date.--This act shall take effect
    19  immediately.
