                                     AN ACT

     1  To provide from the General Fund for the expenses of the          <--
     2     Executive, Legislative and Judicial Departments of the
     3     Commonwealth, the public debt and for the public schools for
     4     the fiscal year July 1, 1991, to June 30, 1992, and for the
     5     payment of bills incurred and remaining unpaid at the close
     6     of the fiscal year ending June 30, 1991; to provide
     7     appropriations from the State Lottery Fund, the Pennsylvania
     8     Economic Revitalization Fund, the Energy Conservation and
     9     Assistance Fund, the Hazardous Material Response Fund, The
    10     State Stores Fund and the Emergency Medical Services
    11     Operating Fund to the Executive Department; to provide
    12     appropriations from the Judicial Computer System Augmentation
    13     Account to the Judicial Department; to provide appropriations
    14     from the Motor License Fund for the fiscal year July 1, 1991,
    15     to June 30, 1992, for the proper operation of the several
    16     departments of the Commonwealth and the Pennsylvania State
    17     Police authorized to spend Motor License Fund moneys; to
    18     provide for the appropriation of Federal funds to the
    19     Executive and Judicial Departments of the Commonwealth and
    20     for the establishment of restricted receipts accounts for the
    21     fiscal year July 1, 1991, to June 30, 1992, and for the
    22     payment of bills incurred and remaining unpaid at the close
    23     of the fiscal year ending June 30, 1991.

    19     The General Assembly of the Commonwealth of Pennsylvania
    20  hereby enacts as follows:
    21                               PART I
    22                         GENERAL PROVISIONS
    23     Section 101.  Short title.--This act shall be known and may
    24  be cited as the General Appropriation Act of 1991.
    25     Section 102.  Definitions.--The following words and phrases
    26  when used in this act shall have the meanings given to them in
    27  this section unless the context clearly indicates otherwise:
    28     "Employees."  Includes all directors, superintendents, bureau
    29  or division chiefs, assistant directors, assistant
    30  superintendents, assistant chiefs, experts, scientists,

     1  engineers, surveyors, draftsmen, accountants, secretaries,
     2  auditors, inspectors, examiners, analysts, statisticians,
     3  marshals, clerks, stenographers, bookkeepers, messengers and
     4  other assistants in any department, board or commission.
     5     "Expenses" and "maintenance."  Includes all printing, binding
     6  and stationery, food and forage, materials and supplies,
     7  traveling expenses, training, motor vehicle supplies and
     8  repairs, freight, express and cartage, postage, telephones and
     9  telegraph rentals and toll charges, newspaper advertising and
    10  notices, public advertising by or through any medium, fuel,
    11  light, heat, power and water, minor construction and renovation,
    12  repairs or reconstruction of equipment, buildings and
    13  facilities, rent of real estate and equipment, premiums on
    14  workmen's compensation, insurance premiums on policies of
    15  liability insurance, insurance premiums on medical payment
    16  insurance and surety bonds for volunteer workers, premiums on
    17  employee group life insurance and employee and retired employee
    18  group hospital and medical insurance, payment of Commonwealth
    19  share of Social Security taxes and unemployment compensation
    20  costs for State employees, the purchase of replacement or
    21  additional equipment and machinery and all other incidental
    22  costs and expenses, including payment to the Department of
    23  General Services of mileage and other charges for the use of
    24  automobiles and rental payments for permanently assigned
    25  automobiles and of expenses or costs of services incurred
    26  through the Purchasing Fund. The term "expenses" also shall
    27  include the medical costs for the treatment of inmates of State
    28  institutions when the inmate must be transferred to an outside
    29  hospital: Provided, That in no case shall the State institution
    30  pay more for patient care than that provided under the State

     1  medical assistance program.
     2     Section 103.  Abbreviations.--The following abbreviations
     3  when used in this act shall have the meanings given to them in
     4  this section unless the context clearly indicates otherwise:
     5     "ADA."  Anti-Drug Abuse.

     7  Services Block Grant.
     8     "AFDC."  Aid to Families with Dependent Children.

    21  be necessary, are hereby specifically appropriated from the
    22  General Fund to the several hereinafter named agencies of the
    23  Executive, Legislative and Judicial Departments of the
    24  Commonwealth for the payment of salaries, wages or other
    25  compensation and travel expenses of the duly elected or
    26  appointed officers and employees of the Commonwealth, for the
    27  payment of fees for contractual services rendered, for the
    28  purchase or rental of goods and services, printing, public
    29  advertising by or through any medium, equipment, land and
    30  buildings and for payment of any other expenses, as provided by

     1  law or by this act, necessary for the proper conduct of the
     2  duties, functions and activities and for the purposes
     3  hereinafter set forth for the fiscal year beginning July 1,
     4  1991, and for the payment of bills incurred and remaining unpaid
     5  at the close of the fiscal year ending June 30, 1991.
     6     (b) SECTION 104.  STATE APPROPRIATIONS.--(A)  State Lottery    <--
     7  Fund.--The following sums set forth in this act, or as much
     8  thereof as may be necessary, are hereby specifically
     9  appropriated from the State Lottery Fund to the several
    10  hereinafter named agencies of the Executive Department of the
    11  Commonwealth for the payment of fees for contractual services
    12  rendered, for the purchase or rental of goods and services and
    13  for payment of any other expenses, as provided by law or by this
    14  act, necessary for the proper conduct of the duties, functions
    15  and activities and for the purposes hereinafter set forth for
    16  the fiscal year beginning July 1, 1991, and for the payment of
    17  bills incurred and remaining unpaid at the close of the fiscal
    18  year ending June 30, 1991.
    19     (c) (B)  Pennsylvania Economic Revitalization Fund.--The       <--
    20  following sums set forth in this act, or as much thereof as may
    21  be necessary, are hereby specifically appropriated from the
    22  Pennsylvania Economic Revitalization Fund to the several
    23  hereinafter named agencies of the Executive Department of the
    24  Commonwealth for the payment of fees for contractual services
    25  rendered, for the purchase or rental of goods and services and
    26  for the payment of any other expenses, as provided by law or by
    27  this act, necessary for the proper conduct of the duties,
    28  functions and activities and for the purposes hereinafter set
    29  forth for the fiscal year beginning July 1, 1991, and for the
    30  payment of bills incurred and remaining unpaid at the close of

     1  the fiscal year ending June 30, 1991.
     2     (d) (C)  Energy Conservation and Assistance Fund.--The         <--
     3  following sums set forth in this act, or as much thereof as may
     4  be necessary, are hereby specifically appropriated from the
     5  Energy Conservation and Assistance Fund to the several
     6  hereinafter named agencies of the Executive Department of the
     7  Commonwealth for the payment of fees for contractual services
     8  rendered, for the purchase or rental of goods and services and
     9  for the payment of any other expenses, as provided by law or by
    10  this act, necessary for the proper conduct of the duties,
    11  functions and activities and for the purposes hereinafter set
    12  forth for the fiscal year beginning July 1, 1991, and for the
    13  payment of bills incurred and remaining unpaid at the close of
    14  the fiscal year ending June 30, 1991.
    15     (e) (D)  Judicial Computer System Augmentation Account.--The   <--
    16  following sums set forth in this act, or as much thereof as may
    17  be necessary, are hereby specifically appropriated from the
    18  restricted receipt account established within the General Fund,
    19  known as the Judicial Computer System Augmentation Account, to
    20  the Judicial Department of the Commonwealth for the payment of
    21  fees for contractual services rendered, for the purchase or
    22  rental of goods and services and for the payment of any other
    23  expenses, as provided by law or by this act, necessary for the
    24  proper conduct of the duties, functions and activities and for
    25  the purposes hereinafter set forth for the fiscal year beginning
    26  July 1, 1991, and for the payment of bills incurred and
    27  remaining unpaid at the close of the fiscal year ending June 30,
    28  1991.
    29     (f) (E)  Emergency Medical Services Operating Fund.--The       <--
    30  following sums set forth in this act, or as much thereof as may

     1  be necessary, are hereby specifically appropriated from the
     2  Emergency Medical Services Operating Fund to the several
     3  hereinafter named agencies of the Executive Department of the
     4  Commonwealth for the payment of fees for contractual services
     5  rendered, for the purchase or rental of goods and services and
     6  for the payment of any other expenses, as provided by law or by
     7  this act, necessary for the proper conduct of the duties,
     8  functions and activities and for the purposes hereinafter set
     9  forth for the fiscal year beginning July 1, 1991, and for the
    10  payment of bills incurred and remaining unpaid at the close of
    11  the fiscal year ending June 30, 1991.
    12     (g) (F)  The State Stores Fund.--The following sums set forth  <--
    13  in this act, or as much thereof as may be necessary, are hereby
    14  specifically appropriated from The State Stores Fund to the
    15  hereinafter named agency of the Executive Department of the
    16  Commonwealth for the payment of fees for contractual services
    17  rendered, for the purchase or rental of goods and services and
    18  for the payment of any other expenses, as provided by law or by
    19  this act, necessary for the proper conduct of the duties,
    20  functions and activities and for the purposes hereinafter set
    21  forth for the fiscal year beginning July 1, 1991, and for the
    22  payment of bills incurred and remaining unpaid at the close of
    23  the fiscal year ending June 30, 1991.
    24     (h) (G)  Motor License Fund.--The following sums, or as much   <--
    25  thereof as may be necessary, are hereby appropriated from the
    26  Motor License Fund to the hereinafter named agencies of the
    27  Commonwealth for the payment of salaries, wages and other
    28  compensation and travel expenses of the duly elected or
    29  appointed officers and employees of the Commonwealth, for

    16     Section 107.  Block grants.--(a)  Appropriation.--The
    17  following sums set forth in this act, or as much thereof as may
    18  be necessary, are hereby specifically appropriated from the
    19  block grant (BG) funds to the several hereinafter named agencies
    20  of the Executive Department of the Commonwealth for the
    21  purposes, and under the restrictions, for which the funds are
    22  provided for the fiscal year beginning July 1, 1991.
    23     (b)  Small Communities Development Block Grant.--The Small
    24  Communities Development Block Grant (SCDBG) is to assist small
    25  cities and communities that have a high concentration of
    26  impoverished citizens and substandard housing to expand their
    27  low and moderate income housing opportunities and to meet
    28  community development needs.
    29     (c)  Community Services Block Grant.--The Community Services
    30  Block Grant (CSBG) is to provide a range of services and

     1  activities having a measurable and potentially major impact on
     2  the causes of poverty in the community or those areas of the
     3  community where poverty is a particularly acute problem. In
     4  addition, new focus may be placed on the unemployed, both old
     5  and new. Local agencies may lower their eligibility requirements
     6  for recipients to three months to allow greater flexibility to
     7  assure proper consideration of each recipient.
     8     (d)  Education Consolidation and Improvement Block Grant.--
     9  The Education Consolidation and Improvement Block Grant (ECIBG)
    10  will be used for the administration and provision of education
    11  programs in accordance with the requirements of the Omnibus
    12  Budget Reconciliation Act of 1981 and the 1988-1989
    13  reauthorization of ECIA Chapter 2 funds.
    14     (e)  Preventive Health and Health Services Block Grant.--The
    15  Preventive Health and Health Services Block Grant (PHHSBG) is
    16  for the provision of preventive health and other health services
    17  related to emergency medical comprehensive public health,
    18  hypertension, fluoridation, health education, risk reduction,
    19  home health, rape crisis and rodent control.
    20     (f)  Maternal and Child Health Services Block Grant.--The
    21  Maternal and Child Health Services Block Grant (MCHSBG) is to
    22  assure mothers and children access to quality maternal and child
    23  health services, to reduce infant mortality and the incidence of
    24  preventable disease and handicapping conditions among children,
    25  to provide rehabilitative services for blind and disabled
    26  individuals under the age of 16 receiving Supplemental Security
    27  Income benefits and to provide medical services for children
    28  with crippling conditions.
    29     (g)  Alcohol and Drug Abuse and Mental Health Services Block
    30  Grant.--The Alcohol and Drug Abuse and Mental Health Services

     1  Block Grant (ADAMHSBG) will be used for the administration and
     2  provision of drug and alcohol abuse services and community
     3  mental health services in accordance with the requirements of

    24                SPECIAL PROVISIONS FOR FEDERAL FUNDS
    25     Section 1201 1101.  General Fund repository for Federal        <--
    26  funds.--All moneys received from the Federal Government as
    27  contributions or supplements to the departments or agencies of
    28  the Commonwealth or the programs herein provided shall be paid
    29  into the General Fund.
    30     Section 1202 1102.  Limitation on encumbering or spending      <--

     1  Federal funds.--Federal funds shall be encumbered or spent only
     2  to the extent that such funds are estimated as being available
     3  during the fiscal year of the Commonwealth.
     4     Section 1203 1103.  Appropriation of prior unspent Federal     <--
     5  funds.--Any Federal money which has been previously appropriated
     6  by the General Assembly and authorized or allocated by the
     7  Federal Government but remains unspent from prior fiscal years,
     8  and will not be renewed for fiscal year 1991-1992, is hereby
     9  appropriated.
    10     Section 1204 1104.  Subgrants between Federal fund             <--
    11  appropriations.--With the exception of Federal money received
    12  under JTPA and SSBG, subgrants may be made between
    13  appropriations without further approval of the General Assembly.
    14  The Secretary of the Budget shall submit a list of subgrants to
    15  the Chairmen of the House and Senate Appropriations Committees
    16  quarterly. No subgrant to a State agency, however, may be made
    17  from a restricted receipt account without a specific
    18  appropriation by the General Assembly.
    19     Section 1205 1105.  Utilization of emergency Federal funds.--  <--
    20  (a)  Federal funds available for costs and damages resulting
    21  from natural disasters or civil disobedience may be added to an
    22  appropriation contained in this act or to funds appropriated or
    23  may be used for the purposes prescribed by the Federal
    24  Government.
    25     (b)  In addition to the moneys appropriated by this act, all
    26  moneys received from the Federal Government for the purpose of
    27  disaster assistance or relief shall be paid into the General
    28  Fund and are hereby appropriated out of the General Fund to the
    29  departments, boards, commissions or agencies designated by the
    30  Governor.

     1     (c)  In the event of any emergency situation in which the
     2  General Assembly cannot act in sufficient time, the Governor is
     3  authorized through executive authorization to provide up to
     4  $5,000,000 in Federal funds to alleviate the emergency
     5  situation.  For the purposes of this section, "emergency" is
     6  defined as any situation in which there is a chance of, or which
     7  may result in, substantial human suffering.
     8                           PART XIII XII                            <--
     9                      MISCELLANEOUS PROVISIONS
    10     Section 1301 1201.  Prior laws unaffected.--This act is not    <--
    11  intended to be inconsistent with or to repeal any provision of
    12  any act enacted at this or any prior session of the General
    13  Assembly regulating the purchase of supplies, the ordering of
    14  printing and binding, the purchase, maintenance and use of
    15  automobiles, the method of making payments from the State
    16  Treasury for any purpose or the functioning of any
    17  administrative department, board or commission.
    18     Section 1302 1202.  Compliance with other law before funds     <--
    19  available.--No appropriation made by this act to any department,
    20  board, commission or agency of the Executive Department shall be
    21  available unless and until the department, board, commission or
    22  agency has complied with sections 615 and 616 of the act of
    23  April 9, 1929 (P.L.177, No.175), known as The Administrative
    24  Code of 1929.
    25     Section 1303 1203.  Contracts prerequisite to encumbering or   <--
    26  committing funds.--Funds for the purchase of supplies, materials
    27  and equipment shall not be deemed to be committed or encumbered
    28  until contracts covering the purchase have been entered into
    29  with the vendors.
    30     Section 1304 1204.  Minority business set-asides.--(a)  Each   <--

     1  department or other instrumentality of the Commonwealth listed    <--
     2  in Subpart A of Part II, authorized to contract for buildings,
     3  highways, commodities, equipment, supplies or services, shall
     4  report to the General Assembly all information pertinent to
     5  anticipated procurement needs at the beginning of each fiscal
     6  year and each fiscal quarter thereafter.
     7     (b)  As used in this section, the term "minority business"
     8  means a minority business enterprise as defined in the act of
     9  July 22, 1974 (P.L.598, No.206), known as the Pennsylvania
    10  Minority Business Development Authority Act.
    11     Section 1305 1205.  Appropriation of funds from miscellaneous  <--
    12  sources.--(a)  In addition to the amounts appropriated by this
    13  act, moneys received in payment for food and household supplies
    14  furnished to employees and other persons, except inmates, by an
    15  institution, and moneys received from the proceeds from the sale
    16  of any products of the soil, meats, livestock, timber or other
    17  materials sold by the department shall be paid into the General
    18  Fund and are hereby appropriated out of the General Fund to the
    19  several respective institutions for the operation and
    20  maintenance of the institutions.
    21     (b)  In addition to the amounts appropriated by this act, all
    22  moneys received from any other source, except the Federal
    23  Government, as contributions for the programs provided herein or
    24  as payment for services or materials furnished by one
    25  institution to another, except those collections designated as
    26  revenues, shall be paid into the General Fund and are hereby
    27  appropriated out of the General Fund for the purposes of the
    28  respective appropriations.
    29     (c)  In addition to any funds specifically appropriated by
    30  this act, all moneys received by a department or agency of the

     1  Commonwealth from any other sources, except the Federal
     2  Government, as contributions or supplements to the department or
     3  agency for a program or administration of an act included in
     4  this act shall be paid into the General Fund and credited to the
     5  appropriation for that program or administration of the act.
     6     Section 1306 1206.  Legislative Department contingencies.--    <--
     7  The amounts appropriated in Subpart B of Part II to the Senate
     8  and the House of Representatives and to the various agencies,
     9  boards, bureaus, commissions, committees and other entities
    10  thereunder shall be subject to the contingency that lapses of no
    11  less than $20,000,000 from prior year appropriations shall be
    12  made from the various Legislative Department accounts.
    13     Section 1307 1207.  Employee leave without pay plan.--(a)      <--
    14  Each executive, legislative and judicial agency, authority,
    15  board, commission and department and each independent agency,
    16  authority, board and commission shall submit to the Secretary of
    17  the Budget a plan which has been developed for implementation to
    18  assure that during the fiscal year July 1, 1991, to June 30,
    19  1992, each employee of that agency, authority, board, commission
    20  and department shall be required to take five days of leave
    21  without pay.
    22     (b)  No more than 25% of funds appropriated from the General
    23  Fund or from any restricted account within the General Fund or
    24  any other funds shall be expended for employee salaries and
    25  benefits after September 30, 1991, if the Secretary of the
    26  Budget has not certified to the General Assembly that the plans
    27  required under subsection (a) have been submitted for
    28  implementation.
    29     (c)  It is the intent of the General Assembly that each
    30  elected or appointed official whose salary is established by law

     1  will voluntarily donate to the General Fund an amount equal to
     2  five days compensation.
     3     Section 1308 1208.  Lapsing of unused funds.--(a)  Except as   <--
     4  otherwise provided by law or in subsections (b), (c), (d), (e),
     5  (f), (g), (h), (i), (j), (k), (l), (m) and (n), AND (H) that      <--
     6  part of all appropriations in Parts II, III, IV, V, VI, VII,
     7  VIII, IX and X AND IX unexpended, uncommitted or unencumbered as  <--
     8  of June 30, 1992, shall automatically lapse as of that date.
     9     (b)  The appropriations in Part II to the Department of        <--
    10  Community Affairs for housing and redevelopment assistance and
    11  low-interest local government loans shall be two-year continuing
    12  appropriations.
    13     (c)  The appropriations in Part II to the Department of
    14  Environmental Resources for the Chesapeake Bay Pollution
    15  Abatement Program, and the black fly control program shall be
    16  continuing appropriations.
    17     (d)  The appropriation in Part II to the Department of
    18  Military Affairs for the Veterans Memorial Commission shall be a
    19  two-year continuing appropriation.
    20     (e)  The appropriation in Part II to the Pennsylvania
    21  Emergency Management Agency for the State Fire Academy shall be
    22  a two-year continuing appropriation.
    23     (f)  The appropriation in Part II to the Pennsylvania Higher
    24  Education Assistance Agency for loan forgiveness shall be a two-
    25  year continuing appropriation.
    26     (g)  The appropriations in Part II to the Legislative
    27  Department shall be continuing appropriations.
    28     (h) (B)  The appropriation in Part IV III to the Department    <--
    29  of Community Affairs for the Recreation Improvement and
    30  Rehabilitation Act shall be a three-year continuing

     2     (i) (C)  The appropriations in Part IV III to the Department   <--

    19     (n) (H)  Notwithstanding the provisions of subsection (f) of   <--
    20  section 606 of the act of July 1, 1981 (P.L.628, No.5A), known
    21  as the General Appropriation Act of 1981, the appropriation in
    22  Part IV of that act to the Legislative Reapportionment
    23  Commission shall be a continuing appropriation.
