AN ACT 1 To provide from the General Fund for the expenses of the 2 Executive, Legislative and Judicial Departments of the 3 Commonwealth, the public debt and for the public schools for 4 the fiscal year July 1, 1991, to June 30, 1992, and for the 5 payment of bills incurred and remaining unpaid at the close 6 of the fiscal year ending June 30, 1991; to provide 7 appropriations from the State Lottery Fund, the Pennsylvania 8 Economic Revitalization Fund, the Energy Conservation and 9 Assistance Fund, the Hazardous Material Response Fund, The 10 State Stores Fund and the Emergency Medical Services 11 Operating Fund to the Executive Department; to provide 12 appropriations from the Judicial Computer System Augmentation 13 Account to the Judicial Department; to provide appropriations 14 from the Motor License Fund for the fiscal year July 1, 1991, 15 to June 30, 1992, for the proper operation of the several 16 departments of the Commonwealth and the Pennsylvania State 17 Police authorized to spend Motor License Fund moneys; to 18 provide for the appropriation of Federal funds to the 19 Executive and Judicial Departments of the Commonwealth and 20 for the establishment of restricted receipts accounts for the 21 fiscal year July 1, 1991, to June 30, 1992, and for the 22 payment of bills incurred and remaining unpaid at the close 23 of the fiscal year ending June 30, 1991. 24 TABLE OF CONTENTS 25 PART I. Effective date. 17 The General Assembly of the Commonwealth of Pennsylvania 18 hereby enacts as follows: 19 PART I 20 GENERAL PROVISIONS 21 Section 101. Short title.--This act shall be known and may 22 be cited as the General Appropriation Act of 1991. 23 Section 102. Definitions.--The following words and phrases 24 when used in this act shall have the meanings given to them in 25 this section unless the context clearly indicates otherwise: 26 "Employees." Includes all directors, superintendents, bureau 27 or division chiefs, assistant directors, assistant 28 superintendents, assistant chiefs, experts, scientists, 29 engineers, surveyors, draftsmen, accountants, secretaries, 30 auditors, inspectors, examiners, analysts, statisticians, 19910H1536B1797 - 6 -
1 marshals, clerks, stenographers, bookkeepers, messengers and 2 other assistants in any department, board or commission. 3 "Expenses" and "maintenance." Includes all printing, binding 4 and stationery, food and forage, materials and supplies, 5 traveling expenses, training, motor vehicle supplies and 6 repairs, freight, express and cartage, postage, telephones and 7 telegraph rentals and toll charges, newspaper advertising and 8 notices, public advertising by or through any medium, fuel, 9 light, heat, power and water, minor construction and renovation, 10 repairs or reconstruction of equipment, buildings and 11 facilities, rent of real estate and equipment, premiums on 12 workmen's compensation, insurance premiums on policies of 13 liability insurance, insurance premiums on medical payment 14 insurance and surety bonds for volunteer workers, premiums on 15 employee group life insurance and employee and retired employee 16 group hospital and medical insurance, payment of Commonwealth 17 share of Social Security taxes and unemployment compensation 18 costs for State employees, the purchase of replacement or 19 additional equipment and machinery and all other incidental 20 costs and expenses, including payment to the Department of 21 General Services of mileage and other charges for the use of 22 automobiles and rental payments for permanently assigned 23 automobiles and of expenses or costs of services incurred 24 through the Purchasing Fund. The term "expenses" also shall 25 include the medical costs for the treatment of inmates of State 26 institutions when the inmate must be transferred to an outside 27 hospital: Provided, That in no case shall the State institution 28 pay more for patient care than that provided under the State 29 medical assistance program. 30 Section 103. State appropriations.--(a) General Fund.--The 18 following sums set forth in this act, or as much thereof as may 19 be necessary, are hereby specifically appropriated from the 20 General Fund to the several hereinafter named agencies of the 21 Executive, Legislative and Judicial Departments of the 22 Commonwealth for the payment of salaries, wages or other 23 compensation and travel expenses of the duly elected or 24 appointed officers and employees of the Commonwealth, for the 25 payment of fees for contractual services rendered, for the 26 purchase or rental of goods and services, printing, public 27 advertising by or through any medium, equipment, land and 28 buildings and for payment of any other expenses, as provided by 29 law or by this act, necessary for the proper conduct of the 30 duties, functions and activities and for the purposes 19910H1536B1797 - 9 -
1 hereinafter set forth for the fiscal year beginning July 1, 2 1991, and for the payment of bills incurred and remaining unpaid 3 at the close of the fiscal year ending June 30, 1991. 4 (b) State Lottery Fund.--The following sums set forth in 5 this act, or as much thereof as may be necessary, are hereby 6 specifically appropriated from the State Lottery Fund to the 7 several hereinafter named agencies of the Executive Department 8 of the Commonwealth for the payment of fees for contractual 9 services rendered, for the purchase or rental of goods and 10 services and for payment of any other expenses, as provided by 11 law or by this act, necessary for the proper conduct of the 12 duties, functions and activities and for the purposes 13 hereinafter set forth for the fiscal year beginning July 1, 14 1991, and for the payment of bills incurred and remaining unpaid 15 at the close of the fiscal year ending June 30, 1991. 16 (c) Pennsylvania Economic Revitalization Fund.--The 17 following sums set forth in this act, or as much thereof as may 18 be necessary, are hereby specifically appropriated from the 19 Pennsylvania Economic Revitalization Fund to the several 20 hereinafter named agencies of the Executive Department of the 21 Commonwealth for the payment of fees for contractual services 22 rendered, for the purchase or rental of goods and services and 23 for the payment of any other expenses, as provided by law or by 24 this act, necessary for the proper conduct of the duties, 25 functions and activities and for the purposes hereinafter set 26 forth for the fiscal year beginning July 1, 1991, and for the 27 payment of bills incurred and remaining unpaid at the close of 28 the fiscal year ending June 30, 1991. 29 (d) Energy Conservation and Assistance Fund.--The following 30 sums set forth in this act, or as much thereof as may be 19910H1536B1797 - 10 -
1 necessary, are hereby specifically appropriated from the Energy 2 Conservation and Assistance Fund to the several hereinafter 3 named agencies of the Executive Department of the Commonwealth 4 for the payment of fees for contractual services rendered, for 5 the purchase or rental of goods and services and for the payment 6 of any other expenses, as provided by law or by this act, 7 necessary for the proper conduct of the duties, functions and 8 activities and for the purposes hereinafter set forth for the 9 fiscal year beginning July 1, 1991, and for the payment of bills 10 incurred and remaining unpaid at the close of the fiscal year 11 ending June 30, 1991. 12 (e) Judicial Computer System Augmentation Account.--The 13 following sums set forth in this act, or as much thereof as may 14 be necessary, are hereby specifically appropriated from the 15 restricted receipt account established within the General Fund, 16 known as the Judicial Computer System Augmentation Account, to 17 the Judicial Department of the Commonwealth for the payment of 18 fees for contractual services rendered, for the purchase or 19 rental of goods and services and for the payment of any other 20 expenses, as provided by law or by this act, necessary for the 21 proper conduct of the duties, functions and activities and for 22 the purposes hereinafter set forth for the fiscal year beginning 23 July 1, 1991, and for the payment of bills incurred and 24 remaining unpaid at the close of the fiscal year ending June 30, 25 1991. 26 (f) Emergency Medical Services Operating Fund.--The 27 following sums set forth in this act, or as much thereof as may 28 be necessary, are hereby specifically appropriated from the 29 Emergency Medical Services Operating Fund to the several 30 hereinafter named agencies of the Executive Department of the 19910H1536B1797 - 11 -
1 Commonwealth for the payment of fees for contractual services 2 rendered, for the purchase or rental of goods and services and 3 for the payment of any other expenses, as provided by law or by 4 this act, necessary for the proper conduct of the duties, 5 functions and activities and for the purposes hereinafter set 6 forth for the fiscal year beginning July 1, 1991, and for the 7 payment of bills incurred and remaining unpaid at the close of 8 the fiscal year ending June 30, 1991. 9 (g) The State Stores Fund.--The following sums set forth in 10 this act, or as much thereof as may be necessary, are hereby 11 specifically appropriated from The State Stores Fund to the 12 hereinafter named agency of the Executive Department of the 13 Commonwealth for the payment of fees for contractual services 14 rendered, for the purchase or rental of goods and services and 15 for the payment of any other expenses, as provided by law or by 16 this act, necessary for the proper conduct of the duties, 17 functions and activities and for the purposes hereinafter set 18 forth for the fiscal year beginning July 1, 1991, and for the 19 payment of bills incurred and remaining unpaid at the close of 20 the fiscal year ending June 30, 1991. 21 (h) Motor License Fund.--The following sums, or as much 22 thereof as may be necessary, are hereby appropriated from the 23 Motor License Fund to the hereinafter named agencies of the 24 Commonwealth for the payment of salaries, wages and other 25 compensation and travel expenses of the duly elected or 26 appointed officers and employees of the Commonwealth, for 27 contractual services and other expenses necessary for the proper 28 conduct of the duties, functions and activities for the purposes 29 hereinafter set forth for the fiscal year beginning July 1, 30 1991, and for the payment of bills incurred and remaining unpaid 19910H1536B1797 - 12 -
1 at the close of the fiscal year ending June 30, 1991. 2 (i) Aviation Restricted Revenue Account.--The following 3 sums, or as much thereof as may be necessary, are hereby 4 appropriated from the Aviation Restricted Revenue Account in the 5 Motor License Fund to the hereinafter named agencies of the 6 Commonwealth for the purposes set forth herein for the fiscal 7 year beginning July 1, 1991, and for the payment of bills 8 incurred and remaining unpaid at the close of the fiscal year 9 ending June 30, 1991. 10 (j) Hazardous Material Response Fund.--The following sums 11 set forth in Part X, or as much thereof as may be necessary, are 12 hereby specifically appropriated from the Hazardous Material 13 Response Fund to the several hereinafter named agencies of the 14 Executive Department of the Commonwealth for the payment of fees 15 for contractual services rendered, for the purchase or rental of 16 goods and services and for the payment of any other expenses, as 17 provided by law or by Part X, necessary for the proper conduct 18 of the duties, functions and activities and for the purposes 19 hereinafter set forth for the fiscal year beginning July 1, 20 1991, and for the payment of bills incurred and remaining unpaid 21 at the close of the fiscal year ending June 30, 1991. 22 Section 105. Federal augmentation appropriations.--The 23 following Federal augmentation appropriations set forth in this 24 act, or as much thereof as may be necessary, are hereby 25 specifically appropriated from the Federal augmentation funds to 26 the several hereinafter named agencies of the Executive and 27 Judicial Departments of the Commonwealth for the payment of the 28 expenses of implementing and carrying out the programs stated 29 herein for the fiscal year beginning July 1, 1991, and for the 30 payment of bills incurred and remaining unpaid at the close of 19910H1536B1797 - 13 -
1 the fiscal year ending June 30, 1991. Unless otherwise stated, 2 the appropriations include any carryovers from the prior fiscal 3 year. 4 Section 106. Job Training Partnership Act appropriations.-- 5 The following sums set forth in this act, or as much thereof as 6 may be necessary, are hereby appropriated from the Job Training 7 Partnership Act (JTPA) funds to the several hereinafter named 8 agencies of the Executive Department of the Commonwealth for the 9 payment of the expenses of implementing and carrying out the 10 program stated herein for the fiscal year beginning July 1, 11 1991. 12 Section 107. Block grants.--(a) Appropriation.--The 13 following sums set forth in this act, or as much thereof as may 14 be necessary, are hereby specifically appropriated from the 15 block grant (BG) funds to the several hereinafter named agencies 16 of the Executive Department of the Commonwealth for the 17 purposes, and under the restrictions, for which the funds are 18 provided for the fiscal year beginning July 1, 1991. 19 (b) Small Communities Development Block Grant.--The Small 20 Communities Development Block Grant (SCDBG) is to assist small 21 cities and communities that have a high concentration of 22 impoverished citizens and substandard housing to expand their 23 low and moderate income housing opportunities and to meet 24 community development needs. 25 (c) Community Services Block Grant.--The Community Services 26 Block Grant (CSBG) is to provide a range of services and 27 activities having a measurable and potentially major impact on 28 the causes of poverty in the community or those areas of the 29 community where poverty is a particularly acute problem. In 30 addition, new focus may be placed on the unemployed, both old 19910H1536B1797 - 14 -
1 and new. Local agencies may lower their eligibility requirements 2 for recipients to three months to allow greater flexibility to 3 assure proper consideration of each recipient. 4 (d) Education Consolidation and Improvement Block Grant.-- 5 The Education Consolidation and Improvement Block Grant (ECIBG) 6 will be used for the administration and provision of education 7 programs in accordance with the requirements of the Omnibus 8 Budget Reconciliation Act of 1981 and the 1988-1989 9 reauthorization of ECIA Chapter 2 funds. 10 (e) Preventive Health and Health Services Block Grant.--The 11 Preventive Health and Health Services Block Grant (PHHSBG) is 12 for the provision of preventive health and other health services 13 related to emergency medical comprehensive public health, 14 hypertension, fluoridation, health education, risk reduction, 15 home health, rape crisis and rodent control. 16 (f) Maternal and Child Health Services Block Grant.--The 17 Maternal and Child Health Services Block Grant (MCHSBG) is to 18 assure mothers and children access to quality maternal and child 19 health services, to reduce infant mortality and the incidence of 20 preventable disease and handicapping conditions among children, 21 to provide rehabilitative services for blind and disabled 22 individuals under the age of 16 receiving Supplemental Security 23 Income benefits and to provide medical services for children 24 with crippling conditions. 25 (g) Alcohol and Drug Abuse and Mental Health Services Block 26 Grant.--The Alcohol and Drug Abuse and Mental Health Services 27 Block Grant (ADAMHSBG) will be used for the administration and 28 provision of drug and alcohol abuse services and community 29 mental health services in accordance with the requirements of 30 the Omnibus Budget Reconciliation Act of 1981. 19910H1536B1797 - 15 -
1 (h) Low-Income Home Energy Assistance Block Grant.--The Low- 2 Income Home Energy Assistance Block Grant (LIHEABG) is to help 3 lessen the impact of the high cost of energy on low-income 4 families and individuals. 5 (i) Social Services Block Grant.--The Social Services Block 6 Grant (SSBG) is for the provision of social services to eligible 7 persons. 8 (j) Child Care and Development Block Grant.--The Child Care 9 and Development Block Grant (CCDBG) is for the provision of 10 direct child care or to increase the availability of child care 11 for low-income families. 12 PART II 13 GENERAL FUND AND FEDERAL APPROPRIATIONS 14 FOR 1991-1992 15 SUBPART A 16 EXECUTIVE DEPARTMENT 17 Section 201. Governor.--The 18 following amounts are appropriated to 19 the Governor: Federal State 20 For the Office of the Governor: 21 including the maintenance of the 22 Governor's Home, the expense of 23 entertainment of official guests and 24 members of the General Assembly and 25 the Judiciary, participation in the 26 Governor's Conference, the expenses of 27 the Executive Board and the payment of 28 traveling expenses of persons other 29 than employees of the Commonwealth 30 appointed by the Governor to represent 19910H1536B1797 - 16 -
1 or otherwise serve the Commonwealth. 2 State appropriation........ 6,167,000 3 Section 202. No county 15 shall be reimbursed for costs above 16 the actual direct costs, excluding 17 capital outlays, incurred by them for 18 the operation of the courts of common 19 pleas. For the purposes of 20 reimbursement for common pleas court 21 judge authorized positions, no county 22 shall receive less than 75% of the 23 actual reimbursement for court costs 24 provided to them from funds 25 appropriated for the fiscal year July 26 1, 1980, to June 30, 1981. 27 For the purpose of determining the 28 actual direct costs incurred by the 29 counties in the administration and 30 operation of the courts of common 19910H1536B1797 - 161 -

Subgrants between Federal fund 3 appropriations.--With the exception of Federal money received 4 under JTPA and SSBG, subgrants may be made between 5 appropriations without further approval of the General Assembly. 6 The Secretary of the Budget shall submit a list of subgrants to 7 the Chairmen of the House and Senate Appropriations Committees 8 quarterly. No subgrant to a State agency, however, may be made 9 from a restricted receipt account without a specific 10 appropriation by the General Assembly. 11 Section 1205. Utilization of emergency Federal funds.--(a) 12 Federal funds available for costs and damages resulting from 13 natural disasters or civil disobedience may be added to an 14 appropriation contained in this act or to funds appropriated or 15 may be used for the purposes prescribed by the Federal 16 Government. 17 (b) In addition to the moneys appropriated by this act, all 18 moneys received from the Federal Government for the purpose of 19 disaster assistance or relief shall be paid into the General 20 Fund and are hereby appropriated out of the General Fund to the 21 departments, boards, commissions or agencies designated by the 22 Governor. 23 (c) In the event of any emergency situation in which the 24 General Assembly cannot act in sufficient time, the Governor is 25 authorized through executive authorization to provide up to 26 $5,000,000 in Federal funds to alleviate the emergency 27 situation. For the purposes of this section, "emergency" is 28 defined as any situation in which there is a chance of, or which 29 may result in, substantial human suffering. 30 PART XIII 19910H1536B1797 - 182 -
1 MISCELLANEOUS PROVISIONS 2 Section 1301. Prior laws unaffected.--This act is not 3 intended to be inconsistent with or to repeal any provision of 4 any act enacted at this or any prior session of the General 5 Assembly regulating the purchase of supplies, the ordering of 6 printing and binding, the purchase, maintenance and use of 7 automobiles, the method of making payments from the State 8 Treasury for any purpose or the functioning of any 9 administrative department, board or commission. 10 Section 1302. Compliance with other law before funds 11 available.--No appropriation made by this act to any department, 12 board, commission or agency of the Executive Department shall be 13 available unless and until the department, board, commission or 14 agency has complied with sections 615 and 616 of the act of 15 April 9, 1929 (P.L.177, No.175), known as The Administrative 16 Code of 1929. 17 Section 1303. Contracts prerequisite to encumbering or 18 committing funds.--Funds for the purchase of supplies, materials 19 and equipment shall not be deemed to be committed or encumbered 20 until contracts covering the purchase have been entered into 21 with the vendors. 22 Section 1304. Minority business set-asides.--(a) Each 23 department or other instrumentality of the Commonwealth listed 24 in Subpart A of Part II, authorized to contract for buildings, 25 highways, commodities, equipment, supplies or services, shall 26 report to the General Assembly all information pertinent to 27 anticipated procurement needs at the beginning of each fiscal 28 year and each fiscal quarter thereafter. 29 (b) As used in this section, the term "minority business" 30 means a minority business enterprise as defined in the act of 19910H1536B1797 - 183 -
1 July 22, 1974 (P.L.598, No.206), known as the Pennsylvania 2 Minority Business Development Authority Act. 3 Section 1305. Appropriation of funds from miscellaneous 4 sources.--(a) In addition to the amounts appropriated by this 5 act, moneys received in payment for food and household supplies 6 furnished to employees and other persons, except inmates, by an 7 institution, and moneys received from the proceeds from the sale 8 of any products of the soil, meats, livestock, timber or other 9 materials sold by the department shall be paid into the General 10 Fund and are hereby appropriated out of the General Fund to the 11 several respective institutions for the operation and 12 maintenance of the institutions. 13 (b) In addition to the amounts appropriated by this act, all 14 moneys received from any other source, except the Federal 15 Government, as contributions for the programs provided herein or 16 as payment for services or materials furnished by one 17 institution to another, except those collections designated as 18 revenues, shall be paid into the General Fund and are hereby 19 appropriated out of the General Fund for the purposes of the 20 respective appropriations. 21 (c) In addition to any funds specifically appropriated by 22 this act, all moneys received by a department or agency of the 23 Commonwealth from any other sources, except the Federal 24 Government, as contributions or supplements to the department or 25 agency for a program or administration of an act included in 26 this act shall be paid into the General Fund and credited to the 27 appropriation for that program or administration of the act. 28 Section 1306. Legislative Department contingencies.--The 29 amounts appropriated in Subpart B of Part II to the Senate and 30 the House of Representatives and to the various agencies, 19910H1536B1797 - 184 -
1 boards, bureaus, commissions, committees and other entities 2 thereunder shall be subject to the contingency that lapses of no 3 less than $20,000,000 from prior year appropriations shall be 4 made from the various Legislative Department accounts. 5 Section 1307. Employee leave without pay plan.--(a) Each 6 executive, legislative and judicial agency, authority, board, 7 commission and department and each independent agency, 8 authority, board and commission shall submit to the Secretary of 9 the Budget a plan which has been developed for implementation to 10 assure that during the fiscal year July 1, 1991, to June 30, 11 1992, each employee of that agency, authority, board, commission 12 and department shall be required to take five days of leave 13 without pay. 14 (b) No more than 25% of funds appropriated from the General 15 Fund or from any restricted account within the General Fund or 16 any other funds shall be expended for employee salaries and 17 benefits after September 30, 1991, if the Secretary of the 18 Budget has not certified to the General Assembly that the plans 19 required under subsection (a) have been submitted for 20 implementation. 21 (c) It is the intent of the General Assembly that each 22 elected or appointed official whose salary is established by law 23 will voluntarily donate to the General Fund an amount equal to 24 five days compensation. 25 Section 1308. Lapsing of unused funds.--(a) Except as 26 otherwise provided by law or in subsections (b), (c), (d), (e), 27 (f), (g), (h), (i), (j), (k), (l), (m) and (n), that part of all 28 appropriations in Parts II, III, IV, V, VI, VII, VIII, IX and X 29 unexpended, uncommitted or unencumbered as of June 30, 1992, 30 shall automatically lapse as of that date. 19910H1536B1797 - 185 -
1 (b) The appropriations in Part II to the Department of 2 Community Affairs for housing and redevelopment assistance and 3 low-interest local government loans shall be two-year continuing 4 appropriations. 5 (c) The appropriations in Part II to the Department of 6 Environmental Resources for the Chesapeake Bay Pollution 7 Abatement Program, and the black fly control program shall be 8 continuing appropriations. 9 (d) The appropriation in Part II to the Department of 10 Military Affairs for the Veterans Memorial Commission shall be a 11 two-year continuing appropriation. 12 (e) The appropriation in Part II to the Pennsylvania 13 Emergency Management Agency for the State Fire Academy shall be 14 a two-year continuing appropriation. 15 (f) The appropriation in Part II to the Pennsylvania Higher 16 Education Assistance Agency for loan forgiveness shall be a two- 17 year continuing appropriation. 18 (g) The appropriations in Part II to the Legislative 19 Department shall be continuing appropriations. 20 (h) The appropriation in Part IV to the Department of 21 Community Affairs for the Recreation Improvement and 22 Rehabilitation Act shall be a three-year continuing 23 appropriation. 24 (i) The appropriations in Part IV to the Department of 25 Community Affairs for housing and redevelopment economic set- 26 aside and enterprise development shall be two-year continuing 27 appropriations. 28 (j) The appropriation in Part IV to the Department of Labor 29 and Industry for the Pennsylvania Conservation Corps shall be a 30 two-year continuing appropriation. 19910H1536B1797 - 186 -
1 (k) The appropriations in Part IV to the Department of 2 Commerce for business infrastructure development and industrial 3 resource centers shall be two-year continuing appropriations. 4 (l) The appropriation in Part V to the Pennsylvania Energy 5 Office shall be a two-year continuing appropriation. 6 (m) The appropriations in section 921 of Part IX for airport 7 development, runway rehabilitation, business airport grants and 8 real estate tax rebate payments shall be two-year continuing 9 appropriations. 10 (n) Notwithstanding the provisions of subsection (f) of 11 section 606 of the act of July 1, 1981 (P.L.628, No.5A), known 12 as the General Appropriation Act of 1981, the appropriation in 13 Part IV of that act to the Legislative Reapportionment 14 Commission shall be a continuing appropriation. 15 PART XIV 16 EFFECTIVE DATE 17 Section 1401.
