                                     AN ACT

     1  Amending the act of April 9, 1929 (P.L.177, No.175), entitled
     2     "An act providing for and reorganizing the conduct of the
     3     executive and administrative work of the Commonwealth by the
     4     Executive Department thereof and the administrative
     5     departments, boards, commissions, and officers thereof,
     6     including the boards of trustees of State Normal Schools, or
     7     Teachers Colleges; abolishing, creating, reorganizing or
     8     authorizing the reorganization of certain administrative
     9     departments, boards, and commissions; defining the powers and
    10     duties of the Governor and other executive and administrative
    11     officers, and of the several administrative departments,
    12     boards, commissions, and officers; fixing the salaries of the
    13     Governor, Lieutenant Governor, and certain other executive
    14     and administrative officers; providing for the appointment of
    15     certain administrative officers, and of all deputies and
    16     other assistants and employes in certain departments, boards,
    17     and commissions; and prescribing the manner in which the
    18     number and compensation of the deputies and all other
    19     assistants and employes of certain departments, boards and
    20     commissions shall be determined," transferring administration
    21     of the Scotland School for Veterans' Children to the
    22     Department of Military Affairs.

    23     The General Assembly of the Commonwealth of Pennsylvania
    24  hereby enacts as follows:
    25     Section 1.  As much as relates to the Department of Education
    26  in section 202 of the act of April 9, 1929 (P.L.177, No.175),
    27  known as The Administrative Code of 1929, amended July 9, 1976


     1  (P.L.986, No.199) and September 28, 1976 (P.L.1048, No.211) and
     2  repealed in part October 2, 1975 (P.L.298, No.96), November 26,
     3  1978 (P.L.1207, No.283 and November 12, 1982 (P.L.660, No.188),
     4  is amended to read:
     5     Section 202.  Departmental Administrative Boards,
     6  Commissions, and Offices.--The following boards, commissions,
     7  and offices are hereby placed and made departmental
     8  administrative boards, commissions, or offices, as the case may
     9  be, in the respective administrative departments mentioned in
    10  the preceding section, as follows:

    13         Pennsylvania State Board of Censors,
    14         Board of Trustee of Thaddeus Stevens Trade School,
    15         Board of Trustees of Scranton State School for the Deaf,
    16         [Board of Trustees of Scotland School for Veterans'

    18         Public Service Institute Board,
    19         State Board of Private Academic Schools,
    20         State Board of Private Business Schools,
    21         State Board of Private Trade Schools,
    22         State Board of Private Correspondence Schools,
    23         State Board of Education.

    26         Armory Board of the State of Pennsylvania,
    27         Board of Trustees of Scotland School for Veterans'

    30     Section 2.  Section 1311 of the act, amended July 9, 1976

     1  (P.L.986, No.199), is amended to read:
     2     Section 1311.  Boards of Trustees of State Institutions
     3  Within the Department.--The Board of Trustees of Scranton State
     4  School for the Deaf, [the Board of Trustees of Scotland School
     5  for Veterans' Children,] and the Board of Trustees of Thaddeus
     6  Stevens Trade School, shall have general direction and control
     7  of the property and management of their respective institutions.
     8  Each of the boards of trustees shall have the power and its duty
     9  shall be:
    10     (a)  Subject to the approval of the Governor, to elect a
    11  president, principal, or superintendent, of the institution, who
    12  shall, subject to the authority of the board, administer the
    13  institution, and, if deemed advisable, a business manager.
    14     (b)  On nomination by the president, principal, or
    15  superintendent, from time to time, to appoint such officers and
    16  employes as may be necessary;
    17     (c)  To fix the salaries of its employes in conformity with
    18  the standards established by the Executive Board;
    19     (c.1)  To authorize the superintendent or business manager of
    20  the institution to purchase instructional materials, education,
    21  technical, administrative, custodial and maintenance equipment
    22  and supplies not in excess of a cost of one thousand five
    23  hundred dollars ($1,500) without competitive bidding with the
    24  approval of the board of trustees, after notice to the Secretary
    25  of General Services, except that such items shall not be bought
    26  in series to avoid the dollar ceiling, nor shall any items be
    27  included for which the Department of General Services has
    28  contracts, either through schedules or group purchase contracts,
    29  current or proposed;
    30     (d)  Subject to the approval of the Secretary of Education,

     1  to make such by-laws, rules and regulations for the management
     2  of the institution as it may deem advisable.
     3     Section 3.  The act is amended by adding a section to read:
     4     Section 1418.  Scotland School for Veterans' Children.--The
     5  Board of Trustees of Scotland School for Veterans' Children
     6  acting within the Department of Military Affairs shall have
     7  general direction and control of the property and management of
     8  the institution and shall have the power and duty to:
     9     (1)  Elect a president, principal or superintendent of the
    10  institution who shall administer the institution.
    11     (2)  On nomination by the president, principal or
    12  superintendent, from time to time, appoint such officers and
    13  employes as may be necessary.
    14     (3)  Fix the salaries of its employes in conformity with the
    15  standards established by the Executive Board.
    16     (4)  Authorize the superintendent or business manager of the
    17  institution to purchase instructional materials, education,
    18  technical, administrative, custodial and maintenance equipment
    19  and supplies not in excess of a cost of one thousand five
    20  hundred dollars ($1,500) without competitive bidding with the
    21  approval of the board of trustees, after notice to the Secretary

    27     (5)  Make such by-laws, rules and regulations for the

    29     Section 4.  This act shall take effect in 60 days.
