AN ACT 1 Relating to spent carbon recycling facilities; requiring 2 additional permits from the Department of Environmental 3 Resources; requiring notification by the Department of 4 Environmental Resources; and providing penalties. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Short title. 8 This act shall be known and may be cited as the Spent Carbon 9 Recycling Facility Permits Act. 10 Section 2. Declaration of policy. 11 The General Assembly finds that the permitting process for 12 spent carbon recycling facilities is not sufficient to protect 13 the safety and health of citizens of this Commonwealth. The 14 General Assembly further finds that requiring spent carbon 15 recycling facilities to attain incinerator, thermal treatment 16 and commercial treatment-disposal permits which are issued by 17 the Department of Environmental Resources would significantly 18 increase the ability of the Commonwealth in protecting its
1 citizens. 2 Section 3. Definitions. 3 The following words and phrases when used in this act shall 4 have the meanings given to them in this section unless the 5 context clearly indicates otherwise: 6 "Department." The Department of Environmental Resources of 7 the Commonwealth. 8 Section 4. New permit requirements for spent carbon recycling 9 facilities. 10 In addition to any permits required by the department, any 11 spent carbon recycling facility shall attain the following 12 permits as established by the department: 13 (1) An incinerator permit. 14 (2) A thermal treatment permit. 15 (3) A commercial treatment disposal permit. 16 Section 5. Department notification. 17 The department shall notify existing spent carbon recycling 18 facilities of the new permit requirements under section 4 and 19 the permit standards required under section 6 within 90 days of 20 the effective date of this act. 21 Section 6. Establishment of standards by department. 22 The department shall review the standards and requirements of 23 the existing incinerator, thermal treatment and commercial 24 treatment-disposal permits issued by the department and 25 establish such permits in a manner that addresses the recycling 26 process of spent carbon facilities while maintaining the highest 27 standards of health, safety and workplace safety under the 28 current laws of this Commonwealth. 29 Section 7. Closure of facilities for failure to comply. 30 (a) Requirement to apply for permits.--Within one year of 19910H1119B1269 - 2 -
1 the effective date of this act, all companies storing, treating 2 or processing spent carbon must submit completed applications 3 established by the department and required under section 4. 4 (b) Closure of facility.--The department shall suspend all 5 permits to operate spent carbon recycling facilities which do 6 not submit the necessary applications until such time that the 7 department has determined the facility has completed the 8 required applications. 9 Section 8. Penalties. 10 A person who violates any provision of this act, any 11 regulation promulgated hereunder or any order issued hereunder 12 commits a summary offense and shall, upon conviction, be 13 sentenced to pay a fine of not less than $500 nor more than 14 $1,500 per day that the person is in violation of this act. 15 Section 9.
