                                     AN ACT

     1  Amending the act of November 26, 1978 (P.L.1415, No.333),
     2     entitled "An act designating a portion of the Schuylkill
     3     River as a component of the Pennsylvania Scenic Rivers System
     4     in accordance with the Pennsylvania Scenic Rivers Act;
     5     authorizing further classification; providing for
     6     cooperation, limitation of liability and protection of
     7     critical areas, and authorizing the expenditure of moneys,"
     8     relating to designation and classification.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  Section 4 of the act of November 26, 1978
    12  (P.L.1415, No.333), known as the Schuylkill Scenic River Act,
    13  amended March 2, 1988 (P.L.100, No.17), is amended to read:
    14  Section 4.  Designation and classification.
    15     (a)  The portion of the Schuylkill River, including related
    16  adjacent land areas, from [the Forks at Port Clinton] ITS         <--
    17  CONFLUENCE WITH THE WEST BRANCH, Schuylkill County, to Fairmont
    18  Dam, Philadelphia County, [excepting the 5.2 mile segment
    19  between Norristown Dam and Spring Mill Creek,] is designated as
    20  a component of the Pennsylvania Scenic Rivers System under the

     1  Pennsylvania Scenic Rivers Act. The Schuylkill River designation
     2  is extended to include a portion of the Schuylkill River and
     3  related adjacent land areas in Schuylkill and Berks Counties and
     4  portions of the West Branch and Little Schuylkill River
     5  tributaries and their related adjacent land areas in Schuylkill
     6  County. The boundaries of the component and of the classified
     7  segments have been defined by the Department of Environmental
     8  Resources and are shown on the maps entitled "SCHUYLKILL RIVER
     9  STUDY" and "SCHUYLKILL RIVER EXTENSION STUDY" which are on file
    10  and available for public inspection in the Division of Land
    11  Records, Pennsylvania Historical and Museum Commission of the
    12  Commonwealth of Pennsylvania.
    13     (b)  Segments of the component are classified as follows:
    14         (1)  Port Clinton (Forks) to Cross Keys (Bridge)--16.2
    15     river miles--recreational.
    16         (2)  Cross Keys (Bridge) to Reading (Route 422 above
    17     Fritz Island)--12.3 miles--modified recreational.
    18         (3)  Reading (Route 422 Bridge over Fritz Island) to
    19     Douglassville (Bridge)--15.3 river miles--recreational.
    20         (4)  Douglassville (Bridge) to [Norristown Dam--34.2]
    21     Fairmont Dam--49.8 river miles--modified recreational.
    22         [(5)  Spring Mill Creek to Fairmont Dam--10.4 river
    23     miles--modified recreational.]
    24         (6)  Route 209 (Highway) to Cressona Route 183 (Bridge)--
    25     5.0 river miles--recreational.
    26         (7)  Cressona Route 183 (Bridge) to Auburn Basin
    27     (Spillway)--9.6 river miles--modified recreational.
    28         (8)  Auburn Basin (Spillway) to Port Clinton (Forks)--7.4
    29     river miles--recreational.
    30         (9)  Port Clinton (Forks) to [T848 (Bridge)--9.1] New

     1     Ringgold Route 895 (Bridge)--10.9 river miles--pastoral.
     2     [(c)  The Secretary of Environmental Resources is authorized
     3  to classify the 5.2 mile segment between Norristown Dam and
     4  Spring Mill Creek as "modified recreational" when he determines
     5  that it meets the criteria for such classification. When so
     6  classified, that segment shall become art of the Schuylkill
     7  scenic river component designated under this act, and all of the
     8  provisions of this act and of the "Pennsylvania Scenic Rivers
     9  Act" shall become applicable thereto.]
    10     Section 2.  This act shall take effect in 60 days.
