AN ACT
1 Amending Title 66 (Public Utilities) of the Pennsylvania
2 Consolidated Statutes, requiring prior legislative approval
3 for certain public utilities to convey real property which is
4 part of a watershed.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Title 66 of the Pennsylvania Consolidated
8 Statutes is amended by adding a section to read:
9 § 1707. Legislative approval for certain conveyances.
10 (a) General rule.--Except as provided in subsection (b), no
11 public utility which meets the criteria of paragraph (1)(ii) of
12 the definition of "public utility" in section 102 (relating to
13 definitions) and which has the power of eminent domain shall
14 convey any real property which is part of any watershed without
15 specific prior approval by the General Assembly in the form of a
16 law.
17 (b) Exceptions.--The provisions of subsection (a) shall not
18 apply to any conveyance to a State government agency or to a
1 private organization for purposes of managing the real property
2 as watershed land.
3 Section 2. This act shall take effect immediately.
