AN ACT
1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2 Consolidated Statutes, making the appearance in public while
3 under the influence of a controlled substance an offense.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 5505 of Title 18 of the Pennsylvania
7 Consolidated Statutes is amended to read:
8 § 5505. [Public drunkenness] Under influence of alcohol or
9 controlled substance in public place.
10 A person is guilty of a summary offense if he appears in any
11 public place manifestly under the influence of alcohol or a
12 controlled substance, as defined in the act of April 14, 1972
13 (P.L.233, No.64), known as The Controlled Substance, Drug,
14 Device and Cosmetic Act, to the degree that he may endanger
15 himself or other persons or property, or annoy persons in his
16 vicinity.
17 Section 2. This act shall take effect in 60 days.
