                                     AN ACT

     1  Amending the act of December 8, 1982 (P.L.848, No.235), entitled
     2     "An act providing for the adoption of capital projects
     3     related to the repair, rehabilitation or replacement of
     4     highway bridges to be financed from current revenue or by the
     5     incurring of debt and capital projects related to highway and
     6     safety improvement projects to be financed from current
     7     revenue of the Motor License Fund," providing for a timber     <--
     8     bridge program; making an appropriation; and making a repeal.
     9     ADDING LOCAL PROJECTS IN ALLEGHENY COUNTY AND IN CAMBRIA       <--
    10     COUNTY; AND MAKING MATHEMATICAL CORRECTIONS.

    11     The General Assembly of the Commonwealth of Pennsylvania
    12  hereby enacts as follows:
    13     Section 1.  The act of December 8, 1982 (P.L.848, No.235),     <--
    14  known as the Highway-Railroad and Highway Bridge Capital Budget
    15  Act for 1982-1983, is amended by adding a section to read:
    16  Section 15.1.  Demonstration timber bridge program.
    17     (a)  Selection of bridges.--The department may select certain
    18  State highway or non-State highway bridges enumerated in this
    19  act to be constructed with timber in accordance with
    20  specifications prepared or approved by the department.

     1     (b)  Maximum grant amount.--The maximum grant to local
     2  government municipalities shall not exceed the percentage set
     3  forth in section 2(c).
     4     (c)  Appropriation.--The sum of $300,000 is appropriated from
     5  the Motor License Fund for use in the demonstration timber
     6  bridge program to be applied against the nonlocal government
     7  municipality share of a project.
     8     Section 2.  As much of section 201 of the act of July 12,
     9  1988 (P.L., No.13A) entitled "An act itemizing appropriations
    10  required from the Motor License Fund and the State Stores Fund
    11  for the fiscal year July 1, 1988, to June 30, 1989, for the
    12  proper operation of the several departments of the Commonwealth
    13  and the Pennsylvania State Police authorized to spend Motor
    14  License Fund and the State Stores Fund moneys," as allocates
    15  $300,000 of the State appropriation for highway and safety
    16  improvement programs for a timber bridge research, design and
    17  construction program, is repealed.
    18     Section 3.  This act shall take effect immediately.

    23  SECTION 2.  TOTAL AUTHORIZATION FOR BRIDGE PROJECTS.
    24     (A)  THE TOTAL AUTHORIZATION FOR THE COSTS OF THE PROJECTS
    25  ITEMIZED PURSUANT TO SECTION 3 AND TO BE FINANCED FROM CURRENT
    26  REVENUE OR BY THE INCURRING OF DEBT SHALL BE [$3,750,960,950]
    27  $3,752,053,950.
    28     (B)  THE AUTHORIZATION FOR CAPITAL PROJECTS IN THE CATEGORY
    29  OF HIGHWAY PROJECTS TO BE CONSTRUCTED BY THE DEPARTMENT OF
    30  TRANSPORTATION, ITS SUCCESSORS OR ASSIGNS, AND TO BE FINANCED BY

    13     SECTION 2.  SECTION 3(2)(I) AND (11)(I) OF THE ACT, AMENDED
    14  JULY 11, 1989 (P.L.335, NO.56), ARE AMENDED BY ADDING PROJECTS
    15  TO READ:

     2  SECTION 10.  APPROPRIATION.
     3     THE NET PROCEEDS OF THE SALE OF THE OBLIGATIONS HEREIN
     4  AUTHORIZED ARE HEREBY APPROPRIATED FROM THE CAPITAL FACILITIES
     5  FUND TO THE PENNSYLVANIA DEPARTMENT OF TRANSPORTATION IN THE
     6  MAXIMUM AMOUNT OF [$2,367,222,000] $2,367,237,000 TO BE USED BY
     7  IT EXCLUSIVELY TO DEFRAY THE FINANCIAL COSTS OF THE PROJECTS
     8  SPECIFICALLY ITEMIZED IN SECTION 3 OF THIS CAPITAL BUDGET. AFTER
     9  RESERVING OR PAYING THE EXPENSES OF THE SALE OF THE OBLIGATION,
    10  THE STATE TREASURER SHALL PAY OUT TO THE PENNSYLVANIA DEPARTMENT
    11  OF TRANSPORTATION THE MONEYS AS REQUIRED AND CERTIFIED BY IT TO
    12  BE LEGALLY DUE AND PAYABLE.
    13     SECTION 4.  THIS ACT SHALL TAKE EFFECT IMMEDIATELY.
