                                  A RESOLUTION

     1  Memorializing Congress to enact legislation subjecting insurance
     2     companies to the same Federal antitrust regulations that
     3     apply to virtually all other business enterprises.

     4     WHEREAS, The United States Congress has exempted insurance
     5  companies from Federal antitrust laws since 1944 when it enacted
     6  the McCarran-Ferguson Act; and
     7     WHEREAS, The insurance industry has taken advantage of its
     8  immunity from Federal antitrust regulation to fix prices, to
     9  impose unfair insurance policy conditions and to reduce the
    10  availability of insurance, thereby harming consumers, nonprofit
    11  organizations and business firms; and
    12     WHEREAS, The states have failed to fill the regulatory vacuum
    13  created by the absence of Federal antitrust jurisdiction over
    14  insurance companies; and
    15     WHEREAS, There is no compelling reason for granting insurance
    16  companies immunity from Federal antitrust regulation when other
    17  business enterprises are not entitled to such preferential


     1  treatment; therefore be it
     2     RESOLVED, That the House of Representatives of the
     3  Commonwealth of Pennsylvania memorialize the Congress of the
     4  United States to enact legislation subjecting insurance
     5  companies to the same Federal antitrust regulations that apply
     6  to virtually all other business enterprises; and be it further
     7     RESOLVED, That copies of this resolution be transmitted to
     8  the presiding officers of each house of Congress and to each
     9  member of Congress from Pennsylvania.
