AN ACT
1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2 Consolidated Statutes, providing for exposure to acquired
3 immune deficiency syndrome.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Title 18 of the Pennsylvania Consolidated
7 Statutes is amended by adding a section to read:
8 § 3129. Exposure to acquired immune deficiency syndrome.
9 (a) Offense defined.--An individual who is a carrier of the
10 human immunodeficiency virus (HIV) commits a misdemeanor of the
11 first degree when the individual, with knowledge of being a
12 carrier of the human immunodeficiency virus, does all of the
13 following:
14 (1) Engages in sexual intercourse with a partner.
15 (2) Does not, prior to engaging in sexual intercourse
16 under paragraph (1), notify the partner that the individual
17 is a carrier of the human immunodeficiency virus.
1 (b) Penalty.--Upon conviction of an offense under subsection
2 (a), the individual shall be sentenced to pay a fine of not more
3 than $3,000 or to imprisonment for not more than three years, or
4 both.
5 Section 2. This act shall take effect in 60 days.
