                                     AN ACT

     1  Amending the act of June 3, 1937 (P.L.1333, No.320), entitled
     2     "An act concerning elections, including general, municipal,
     3     special and primary elections, the nomination of candidates,
     4     primary and election expenses and election contests; creating
     5     and defining membership of county boards of elections;
     6     imposing duties upon the Secretary of the Commonwealth,
     7     courts, county boards of elections, county commissioners;
     8     imposing penalties for violation of the act, and codifying,
     9     revising and consolidating the laws relating thereto; and
    10     repealing certain acts and parts of acts relating to
    11     elections," placing certain limitations on contributions.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14     Section 1.  Section 1634 of the act of June 3, 1937
    15  (P.L.1333, No.320), known as the Pennsylvania Election Code,
    16  amended October 4, 1978 (P.L.893, No.171) and November 26, 1978
    17  (P.L.1313, No.318), is amended to read:
    18     Section 1634.  [Contributions by Agents; Anonymous
    19  Contributions; Cash] Unlawful Contributions.--
    20     (a)  It shall be unlawful for any person to make any
    21  contribution with funds designated or given to him for the
    22  purpose by any other person, firm or corporation. Each person

     1  making a contribution shall do so only in his own name.
     2     (b)  It shall be unlawful for any candidate or political
     3  committee to disburse money received from an anonymous source.
     4  All such money shall be handed over to the State Treasurer
     5  within twenty (20) days of its receipt.
     6     (c)  It shall be unlawful for any person to make
     7  contributions of currency of the United States or currency of
     8  any foreign country to or for the benefit of any candidate which
     9  in the aggregate, exceed one hundred dollars ($100), with
    10  respect to any candidate for election.
    11     (d)  It shall be unlawful for any Political Action Committee
    12  to make contributions to a candidate or to a Candidate's
    13  Political Committee which, in the aggregate, exceed five
    14  thousand dollars ($5,000), in an election year and the preceding
    15  nonelection year or years.
    16     (e)  It shall be unlawful for any candidate or Candidate's
    17  Political Committee to accept any contributions from any person
    18  or Political Action Committee at any time other than the year
    19  the election in which the candidate is seeking election is held.
    20     (f)  It shall be unlawful to transfer contributions from one
    21  Candidate's Political Committee to another Candidate's Political
    22  Committee or other political committee.
    23     (g)  It shall be unlawful for a Political Action Committee to
    24  contribute in excess of five thousand dollars ($5,000) to any
    25  other Political Action Committee, or political committee other
    26  than a Candidate's Political Committee in any one year.
    27     (h)  It shall be unlawful for a Political Action Committee to
    28  spend, in the aggregate, in excess of fifty thousand dollars
    29  ($50,000) for all contributions to candidates, Candidate's
    30  Political Committees, and any other political committees in a

     1  nonelection year, or to spend, in the aggregate, in excess of
     2  two hundred thousand dollars ($200,000) for all such
     3  contributions in a election year.
     4     Section 2.  This act shall take effect immediately.
