        AS REPORTED FROM COMMITTEE ON HEALTH AND WELFARE, HOUSE OF
           REPRESENTATIVES, AS AMENDED, NOVEMBER 24, 1987

                                     AN ACT

     1  Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
     2     act to consolidate, editorially revise, and codify the public
     3     welfare laws of the Commonwealth," further providing for
     4     eligibility for medical assistance.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 441.1 of the act of June 13, 1967
     8  (P.L.31, No.21), known as the Public Welfare Code, added July
     9  31, 1968 (P.L.904, No.273), is amended to read:
    10     Section 441.1.  Persons Eligible for Medical Assistance.--The
    11  following persons shall be eligible for medical assistance:
    12     (1)  Persons who receive or are eligible to receive cash
    13  assistance grants under this article;
    14     (2)  Persons who meet the eligibility requirements of this
    15  article for cash assistance grants except for citizenship,
    16  durational residence and any eligibility condition or other
    17  requirement for cash assistance which is prohibited under Title
    18  XIX of the Federal Social Security Act; and

     1     (3)  The medically needy.
     2     (4)  Pregnant women and children under the age of five whose
     3  income is one hundred percent of the poverty level. For the
     4  purpose of this clause, these recipients shall be entitled to
     5  all medical assistance benefits available to persons deemed
     6  categorically needy as provided for in clause (1).
     7     Section 2.  This act shall take effect in 60 days.             <--
     8     SECTION 2.  THE ACT IS AMENDED BY ADDING A SECTION TO READ:    <--
     9     SECTION 443.7.  PRESUMPTIVE ELIGIBILITY FOR PREGNANT WOMEN.--
    10  THE DEPARTMENT SHALL PROVIDE FOR MAKING AMBULATORY PRENATAL CARE
    11  AVAILABLE TO PREGNANT WOMEN DURING A PRESUMPTIVE ELIGIBILITY
    12  PERIOD AS PROVIDED BY SECTION 1920(A) OF THE SOCIAL SECURITY ACT
    13  (PUBLIC LAW 74-271, 42 U.S.C. § 1396 R-1(A)), AS AMENDED BY
    14  SECTION 9407 OF THE OMNIBUS BUDGET RECONCILIATION ACT OF 1986
    15  (PUBLIC LAW 99-509, 100 STAT. 1874).
    16     SECTION 3.  THIS ACT SHALL TAKE EFFECT FEBRUARY 1, 1988.
