                                     AN ACT

     1  Protecting the health and welfare of the citizens of this
     2     Commonwealth by regulating the siting of commercial volume
     3     reduction facilities.

     4     The General Assembly hereby finds as follows:
     5         (1)  That there may be an increase in cancer and death
     6     rates occurring in populations situated near these
     7     facilities, as indicated by certain statistics of the
     8     Department of Health.
     9         (2)  That it is of the utmost importance to safeguard the
    10     safety, health and welfare of the citizens of our
    11     Commonwealth and that therefore this legislation is necessary

     1     for that purpose.
     2     The General Assembly of the Commonwealth of Pennsylvania
     3  hereby enacts as follows:
     4  Section 1.  Commercial low-level radioactive waste volume
     5                 reduction facilities.
     6     (a)  Disposal site required.--Any commercial low-level
     7  radioactive waste volume reduction facility shall be sited
     8  immediately adjacent to a low-level radioactive waste disposal
     9  facility established pursuant to the provisions of law.
    10     (b)  Application.--The provisions of this act shall include
    11  volume reduction facilities which have been issued requisite
    12  State and Federal permits but which have not yet initiated
    13  operations.
    14     (c)  Definitions.--As used in this section, the term
    15  "commercial low-level radioactive waste volume reduction
    16  facility" means a facility which, for a fee, reduces the volume
    17  of low-level radioactive waste by means of incineration. The
    18  term does not apply to:
    19         (1)  Commercial volume reduction facilities which reduce
    20     the volume of low-level radioactive waste by means of
    21     compaction.
    22         (2)  Volume reduction facilities which compact,
    23     incinerate or otherwise process any low-level radioactive
    24     waste generated on the premises of that facility, including,
    25     but not limited to, volume reduction facilities situated on
    26     the premises of hospitals and research laboratories.
    27  Section 2.  Effective date.
    28     This act shall take effect immediately.
