                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing for temporary
     6     special aid to school districts due to real property
     7     reassessments.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 2502.10 of the act of March 10, 1949
    11  (P.L.30, No.14), known as the Public School Code of 1949, added
    12  June 25, 1982 (P.L.643, No.182) and amended December 20, 1983
    13  (P.L.267, No.73), is amended to read:
    14     Section 2502.10.  Temporary Special Aid to School Districts
    15  Due to Real Property Reassessments.--(a)  For the school year
    16  1978-1979 and each school year thereafter, a school district
    17  experiencing a fifteen per centum (15%) loss, or for a school
    18  district with a market value/personal income aid ratio of five
    19  tenths (.5) or greater, experiencing at least a seven and one-
    20  half per centum (7 1/2%) loss, in total local revenue for the

     1  support of the public schools in any one (1) year due to the
     2  reassessment of one or more properties within the boundaries of
     3  the public school district shall qualify for special aid for a
     4  period of two (2) years on the condition that the school
     5  district tax rates which were in effect at the time of the
     6  reassessment are not reduced. Countywide reassessment shall not
     7  qualify a district for this special aid.
     8     (b)  During the first year of the reduction in revenue caused
     9  by the reassessment, a school district shall qualify for and
    10  receive a special grant equal to fifty per centum (50%) of the
    11  reduction, and in the following school year the district shall
    12  qualify for and receive a special grant equal to twenty-five per
    13  centum (25%) of the reduction in revenue caused by the
    14  reassessment: Provided, however, That a school district that
    15  qualified for such payments prior to the date of this amendatory
    16  act shall receive its first payment in the year this amendatory
    17  act is enacted.
    18     (c)  The special aid authorized by this section shall be paid
    19  from undistributed basic instruction subsidy funds to the extent
    20  that such funds are available.
    21     (d)  The provisions of this subsection shall apply to any
    22  school district qualifying for the temporary aid provided for in
    23  this section and receiving its second year of such aid during
    24  the 1982-1983 school year. For the purpose of computing a school
    25  district's equalized subsidy for basic education for the 1982-
    26  1983 school year, as provided for and limited by 24 Pa.C.S. §
    27  2903(b)(2) (relating to limitation of certain payments), the
    28  Department of Education shall adjust the computation of payments
    29  on account of section 2502.9 of this act for the 1981-1982
    30  school year as follows: the department shall recompute the

     1  district's guarantee, as provided for in section 2502.9(a) of
     2  this act, by adding to the computation of the guarantee for the
     3  1980-1981 school year the amount of the second year payment of
     4  temporary special aid provided for in this section: Provided,
     5  however, That no district shall receive a lesser subsidy for the
     6  1982-1983 school year as a result of such revised computation,
     7  nor a subsidy in excess of the full amount to which it would be
     8  entitled under the provisions of 24 Pa.C.S. §§ 2902 (relating to
     9  payments on account of instruction) and 2905 (relating to
    10  economic supplement) and that no district shall be entitled to
    11  an increased subsidy payment for the 1981-1982 school year as a
    12  result of such revised computation.
    13     Section 2.  This act shall take effect in 60 days.
