AN ACT
1 Prohibiting the acquisition, sale or exchange of certain land by
2 the Department of Environmental Resources without advertising
3 and a public hearing.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Advertising of proposed land transaction.
7 Notwithstanding any other provision of law, the Department of
8 Environmental Resources shall not acquire, sell or exchange any
9 State Forest land or State Park land unless the department has
10 advertised its intention to acquire, sell or exchange the land.
11 The advertisement shall be published on at least three different
12 days not less than 120 days nor more than 150 days prior to the
13 acquisition, sale or exchange in at least one newspaper of
14 general circulation within the county in which the land is
15 situated. The advertisement shall include a brief summary of the
16 proposed acquisition, sale or exchange and the time and place at
17 which a public hearing will be held on the proposed acquisition,
1 sale or exchange.
2 Section 2. Public hearing on proposed land transaction.
3 Notwithstanding any other provision of law, the Department of
4 Environmental Resources shall not acquire, sell or exchange any
5 State Forest land or State Park land unless the department has
6 conducted at least one public hearing on the proposed
7 acquisition, sale or exchange in the county in which the land is
8 situated. The public hearing shall be conducted at the time and
9 place designated in the advertisement required by section 1. The
10 hearing shall not occur later than 90 days prior to the
11 acquisition, sale or exchange or earlier than 30 days after the
12 third publication of the advertisement required by section 1.
13 Section 3. Effective date.
14 This act shall take effect immediately.
