                                     AN ACT

     1  Amending the act of December 15, 1971 (P.L.596, No.160),
     2     entitled "An act providing for the control and regulation of
     3     outdoor advertising adjacent to the interstate and primary
     4     highway systems within this Commonwealth; providing for
     5     administration by the Department of Transportation to comply
     6     with Federal requirements as a condition to the receipt of
     7     highway funds; fixing penalties and making appropriations,"
     8     further providing for permits.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  Section 7 of the act of December 15, 1971
    12  (P.L.596, No.160), known as the Outdoor Advertising Control Act
    13  of 1971, amended December 19, 1975 (P.L.565, No.161), is amended
    14  to read:
    15     Section 7.  Permits.--An annual permit shall be required for
    16  each outdoor advertising device regulated by this act and
    17  located outside the limits of those incorporated municipalities
    18  that have legally established and operating procedures for
    19  issuing permits for such outdoor advertising devices which have
    20  been certified by the secretary as conforming to the provisions


     1  of subsection (d) of section 5 of this act. This section shall
     2  not apply to an outdoor advertising device that advertises for a
     3  business located on the same premises as the device. The fee for
     4  each such permit shall be ten dollars ($10) if the sign area
     5  does not exceed three hundred square feet; twenty dollars ($20)
     6  if the sign area exceeds three hundred square feet but does not
     7  exceed six hundred square feet; and thirty dollars ($30) if the
     8  sign area exceeds six hundred square feet: Provided, however,
     9  That no fee shall be payable by service clubs or religious
    10  organizations. A tag indicating that a permit has been duly
    11  issued shall be provided by the department and affixed to the
    12  device or structure by the sign owner except in the case of a
    13  free permit where the device or structure is not owned by the
    14  service club or religious organization, the permit shall be
    15  affixed thereto by the service club or religious organization.
    16     Section 2.  This act shall take effect in 60 days.
